Résumé:
تعد معادلة التناسب أساس القانون الدولي الإنساني في الحرب، إذ تهدف إلى تحقيق التوازن بين الاعتبارات العسكرية وأهمها إلحاق الهزيمة بالعدو من جهة، وبين الاعتبارات الإنسانية وحفظ كرامة وحقوق الإنسان من جهة أخرى، بهدف الوصول إلى أنسنة الحرب على الأقل إذا لم تكف الجهود الإنسانية إلى حد الآن بالقضاء عليها أصلا.
وتجمع معادلة التناسب بين العديد من مبادئ القانون الدولي المتداخلة فيما بينها، والتي تعتبر استثناءات فيما بينها وعلى بعضها البعض، حيث يشكل التداخل بين هذه المبادئ الأساس القانوني لهذه المعادلة، ويشمل تحقيق معادلة التناسب بين الاعتبارات العسكرية والاعتبارات الإنسانية كل من الوسائل والأساليب المختارة من طرف القائد العسكري الذي يقع عليه عبء تطبيق هذه المعادلة.
تعد معادلة التناسب معادلة صعبة ودقيقة التطبيق خاصة في ساحة القتال، فهي تحتاج لتطبيقها إلى قائد يكرس جهده وعمله لتحقيقها، وعلى التدريب المسبق للقائد والجنود وقت السلم، لا سيما التكوين في مجال القانون الدولي الإنساني والاحاطة بتقنيات تطبيق المعادلة، والتأكيد على أن تقاعس القائد العسكري عن اتخاذ التدابير القانونية اللازمة لتطبيقها، يؤدي إلى قيام مسؤوليته المباشرة وغير المباشرة عن انتهاك قواعد القانون الدولي الإنساني.

In the event that the military commander fails to take the necessary legal measures, his direct responsibility is to violate the rules of international humanitarian law.
