التأويل والمعنى عند: الفقهاء والمفسرين من القرن الثني هجري إلى القرن الثامن الهجري - دراسة لسانية تداولية

Abstract

تعد ظاهرة التأويل والمعنى من الظواهر اللغوية المهمة، والتي ترتبت عنها خلافات بين الفقهاء، والمفسرين، بين مثبت للظاهرتين ومن مذكر لها وبخاصة ظاهرة التأويل لكونها ذات منطلقات فلسفية تمس بالجانب العقدي. وقد تناولنا في هذه الرسالة جملة من النقاط المتعلقة بظاهرة التأويل والمعنى منها التأصيلا الدقيق لظاهرة التأويل والمعنى وموقف كل من الشافعي والسرخسي وابن قدامة وابن تيمية والطبري وابن قيم الجوزية،وقد تبين لنا اختلافا في دراسة ظاهرة التأويل والمعنى، لكن ما نلحظه اتفاقهم في معالجة الظاهرة من حيث الأصل؛ والاختلاف في الفرع على مستوى المصطلحات العلمية لآليات التأويل والمعنى، وعند اختلافهم في الفرع كان في اطار معالجة النص الشرعي،وما احتواه من أحكام شرعية لكن القصد واحد. هو استنباط الحكم الشرعي صحيح وهذا الاستنباط للأحكام الشرعية كان ضمن حقل خصب. وقد بحثنا في ظاهرتين بالتمثيل من خلال ما أورده أصحاب المدونات المدروسة في بحثنا هذا، مع التحليل و بيان معالجتهم في استنباط الأحكام الشرعية، وفقا لما هو واضح في وقتنا المعاصر باعتماد المنهج التداولي وإن كانت الاختلافات في وضع بعض المصطلحات وليس في المفاهيم. ........................................................................................................................................................................ Phenomenone of interpratation is among the most significant linguistic phenomenona which resulted in disputes among jurists and exegetes of the holy Quran whether those who confirmed it or denied it. This is becaues this phenomenon has philosophical outestes that tackle the creed and we in this distration tackle mang pertinent points of phenomenon of interpretation and meaning. The research applies the concept by alshafii, assarakhsi, ibn Qoudama, ibn taymaya and, attabari and ibn Qayam aljawzya it becomes clear that they differed. However,they agreed in the way of tackling the issue, they agreed such as terminology and interpretation mechanisms whithin the frame of jurisprudent understanding. Yet, the objective is one such reasaning was made in fertile field. We scrutinize the two phenomena through what the compilers of blogs mentioned and analyzed of juristic reasaning of the contemporary applied pragmatic approach taking into consediration disparity of terminology and not conceptions.
