Abstract

يُـــــــــركِّــــــــزُ مــــــــوضــــــوع الــــــبــــحــــــث عـــلــــى تـــــحــــــلــــيـــل مــــنـــــظــــــومـــــــــة " الــحــــــقــــــوق الانــــتــــــخــــابــــــــيَّــــــــة فـــــــي مــــــــرحــــلــــة مــا قـــــــبــل الاقـــــــتــــــــراع" مــن زاويــــــة ضـــــرورة الـــــتــــــــزامِ الـــنُّــــــصُــــــوص الــــتَّــــفـــصـــيـــلــــيَّـــــة - ســـــواءً أكــــانــــت عــــضــــــويَّـــــــــةً أم عــــــاديَّـــــــــــةً أم فـــــــرعــــــــيَّــــــــــةً – بــــالـمــقــــــتــــضـــيَــــــــــات الـــدُّســـــتـــــــوريَّــــــــــة، مـــــن خـــــلال الـمــــبـــــدأ الــدّســــــتـــــــــوري الـــــــذي يــــــــقــــــــــضــــــي بــــــــ: "حـــــــــقِّ الـــــمـــــواطـــــن فـــــــــي أنْ يَـــــــــنْــــــــــتَـــــــخِــــــبَ وأنْ يُـــــــــــنْـــــــــــتَـــــــــخَـــــــبَ" ضـــمــــن ضـــــــــوابــــــــطٍ مــــعــــــقــــــــولـــــــــةٍ، ومـــــــن أجـــــــل ذلــــــك لابــــــد مـــــن تـــــحــــــديـــــــد وتـــــصـــــــنــــــــــيـــــــف هـــــــذه الــــحــــــقـــــــــــوق، لــــتــــحـــــلـــــيـــل مــــدى كـــفــــالــــتـها، ومـــــــا يـــــــقـــــــتــــــضـــــــيـــــــه ذلـــــك مــــــن تـــــقــــــــويـــــم لــــــضـــمــــانــــــاتِــــــــــهــــا وآلـــــــــــيــــــــــاتِـــــــــــــــهــا، بــــــغــــــــــــيــــــــة إدراك نــــــــقـــــــــــــائــــــــــصـــــــــــها وعـــــــــيــــــــــوبـــــــــــها الـجــــســـيـــــمــــة، بـــــــهــــــــدف تــــــحــــــســـــــــيــــــــن الــــنـــــصــــــوص الـــــقـــــــــانــــــونــــــــيـة والــــــرَّفـــــــع مــــــــن جــــــــودتــــــــــها، بــــــمــــــا يــُــــــــــــؤثِّــــــــــــــــرُ إيـــــــــجــــــــــابًـــــــــــا عــــلـــــــى الــــمُــــحُــــــــصِّـــــــلَــــــــة الــــنِّـــــــهـــــائـــــــيـــــــــة لــــلانـــــــتـــــــخـــــــابــــــــــات، وعــــــلـــى بــــــــنـــــــــاءِ أو إعـــــــــــادةِ بــــــــــنـــــــــاءِ الـــــــثـِّـــــــــــقــــــة فـــــي الــعـــمــلـــــيَّـــــة الانــــتــــــخــــابــــــــيَّــــــــــــــة. ولــــــتـــحـــــقــــــيــــــق هـــــــذا الـــمـــشــــروع انــــطــــــلـــــقــــــنـــــــا مــــــن الإشـــــكــــــالــــــــيـــــــة الآتـــــــــيــــــــــة: كــــــيـــفَ تُــــــــؤَثِّــــــــر الـــــنــــــقـــــائِـــــــص الـــبِـــــنْــــيَــــــــوِيَّــــــــة لـــمـــنـــــظـــــومــــــة الــحــــــقــــوق الانـــتــخــابــــــيَّـــة الـــقــــبـــلـــــــيَّــــة عــلــــى الــــعــمــلـــــيَّـــــة الانـــتــــخـــــابــــــيَّــــة بِــــــــرمَّــــــتِـــــــهَـــا ســـــــــواءً تَــــعــــلَّــــــقَ الأمـــــــر بــــــدورِ الــــسُّـــلْــــطَــــــة الـــــتَّـــشـــــــريـــــعـــــيَّــــــة أم بـــــــدورِ الــــسُّـــلْـــطَــــــــة الإداريـّـــــــــة أم بــــــدور الــــسُّـــلْــــطَــــــة الــــقـــــضـــــائِــــــــــيَّــــــة أو الــــهــــــــيـــــــــئــــات الأخـــــرى – علــى مسـتــــوى الـــنَّـــــص قــبــل المـمـــارســــة – وذلِـــكَ فـــــي الــــنِّـــــظــــامِ الـــقَــــانـُـــــونــــي الــجـــــــــزائـــــــري خـــــصـــــوصًــــا، وفــــــــي الـــــفــــقـــــــه والأنـــــظـــــــمَـــــة الـــمـــقـــارنَــــــة عــــمــــومًـا، وســـواءً أكـــــانَ ذلـــــكَ بــــغـــــــيــــــرِ قـــــصـــــدٍ أم كــــــان انــــحــــــرَافًــــا تـــــشــــــريـــــعــــــيًـــــا مــــقـــــصـــــــودًا ؟ وهـــــذا كــــلــه مـــــن أجــــــل وضــــــع تــــــشــــــريــــــــع جــــــيـــد لــــهـــــذه الــــــحـــــــــقـــــــــــــوق، بــــــمــــــا يـــــــضــــــمــــــــن حــــــمـــــــايـــــــة حــــــــقــــــــيــــــــقـــــــــيــــة لـــــلـــــعــــــمــــــلــــيــــــة الانـــــــتـــــــخـــــــــابـــــــــــيـــــــــة فـــــــــــي مـــــــحــــــــــصِّــــــــــلــــــــــتــــــها الــــــنـــــهـــــائــــــــــيــــــــة، وهـــــــــي الـســـــيــــــــادة الــــشــــــــعــــــــبـــــيـــــــــة. ولـــــتـــفــصــــيــــل هــــذه الإشــكــالــــــيــــة الـمـــحــــوريــــــــة اعــــــتـمــدنــــا تــقـــســـيــــمًــــا مــــنــهــجـــــيًـــــا مـــبـــنـــــيًـــــــا عـلــــى بــابــــــيـــــنِ رئــيــســيــــينِ، تــــنــــاولــــنـــا فـــي الأوَّل مــــنـه الـحــقــوق الانــتــخــابـــيَّــة الـقـــبـلــيَّـة الـمـتـعــلِّــقــة بـــشــــكـــــلـــــيــــات الــعمـلــــــيَّـــــة الانــــتــــخـــــابــــــــيَّـــــــة، وقــــسَّــــمـــــــنــــاه إلــــى فــــصــــــلــــــين، تــضـــمَّــن الــفــصــل الأوَّل الـحـــقّ فـي جودَة عملـيَّة تسجـيــل الـنَّاخـبـــيـن، وتضمَّـــن الــفـــصـــل الــثَّـانــي الـحــقّ فـــي عَــــدالـــة تــقســـيم الدوائــــر الانــتـخابـــــية. أمَّـــــا الباب الثَّانـــي فخصَّصناه لدراسة الحــقــــوق الانـــتــخابــــيــة الـقـــبـلـــيَّــــة الـمـتـــعلِّـقـة بــــــــمــــــــوضـــوع الــعمـلــــــيَّـــــة الانــــتــــخـــــابــــــــيَّـــــــة، وقــــسَّــــمـــــــنــــاه إلــــى فــــصــــــلــــــين أيـــضًـــا، تــضــمَّــن الــفــصــل الأوَّل الــحـــقّ فــي حــــرِّيــَّــــة الــــتـَّــــرشُّـــح ضِـــمْــن ضــــوابــــط مـــعــــقــــولــــة، وتــضــــمَّــــن الـــفـــصـــل الـــــثَّــــانــــي حـــــق الـمــســــاواة بـــيــن الـمــتـــرشــحــيـــن فــي الـحـمـلــة الانـــتخــابـــيَّـــة. ............................................................................................................................................................................... Our research focuses on the electoral rights in the pre-electoral period from the point of view of the necessity for the texts of the organic, ordinary and subsidiary laws to abide by the constitutional requirements in line with the constitutional principle that guarantees the right for all citizens to elect and to be eligible under reasonable rules. These rights and the degree of their protection should therefore be defined together with the necessary reforms and mechanisms for their guarantee and the elimination of any deficiencies and shortcomings since the improvement of the quality of the Legislative texts has a positive impact on voting and gives or restores confidence in the electoral process.

In order to achieve this objective, we have raised the following issue : How can the structural deficiencies of upstream electoral rights affect the entire electoral process through the text before its implementation, be it the legislative, administrative and judicial power and other bodies notably in the Algerian legal system in particular and the comparative systems in general whether it is unintentional act or a deliberate legal deviation ?.

To this end, we have devoted two main titles divided into two chapters: Chapter one is concerned with electoral rights and the formalities of the electoral process. While the first chapter highlights the right to a high-quality electoral registration, the second deals with the right to an fair distribution of electoral districts. In the second title, we have examined the electoral rights prior to the electoral process. The first chapter tackles the right of eligibility) Nomination( under reasonable rules , while the second the right to a fair elections campaign.
