تفعيل مكافحة الرشوة الكبرى: نحو ضرورة الاستعانة باختصاص المحكمة الجنائية الدولية

Abstract

إن ظاهرة الرشوة بصفة عامة بكل أشكالها، والرشوة الكبرى بصفة خاصة، أصبحت من الظواهر التي اجتاحت كل المجتمعات المعاصرة، فأصبحت ظاهرة عابرة للحدود، وأصبح تفاقمها يغذي كل أشكال الأزمات والانتفاضات عبر العالم، فالرشوة بمختلف أشكالها وأبعادها، ترتب آثارا سلبية في جميع الميادين والمجالات سواء على الدولة كشخص معنوي أو على المواطنين كأشخاص طبيعية. رغم ما تم تسخيره من آليات وتم استحداثه من استراتيجيات سواء للوقاية من هذه الظاهرة أو لقمعها، فإنها في تفاقم وانتشار مستمر. إنطلاقا من هذا الواقع، فإن الهدف من هذه الدراسة هو البحث عن امكانية الارتقاء بهذه الآليات إلى آليات أكثر فعالية من بينها إدراج جريمة الرشوة الكبرى ضمن اختصاص المحكمة الجنائية الدولية، لنتوصل في الأخير إلى نتيجة أن هذا الاختصاص يعتبر، على الأقل من الناحية القانونية، ممكنا سواء وفقا لنظامها الأساسي الحالي أو بتكييف يستدعي تعديل هذا النظام وادراجها كجريمة مستقلة. The phenomenon of bribery in general, and serious bribery crime in particular, has become one of the phenomena that invaded all contemporary societies. It became a cross-border phenomenon, and its aggravation has fed all forms of crises and revolutions around the world. bribery crime in its various forms and dimensions has negative effects in all fields, whether on the State as a moral legal entity or on the citizens as natural persons. Despite the mechanisms and strategies that have been made, both to prevent from this phenomenon and to suppress it, but it is still in exacerbating and spreading. Based on this reality, the aim of this study is to look for the possibility of promoting these mechanisms to be more effective; among them is the inclusion of this serious bribery crime within the jurisdiction of the International Criminal Court. Finally, from a legal point of view, we conclude the possibility of this jurisdiction , either in accordance with its current statute, or by an adaptation of this latter, which requires modifying to add it, as a separate crime.
