الأمن القانوني في التشريع الجنائي الجزائري

Abstract

هذه الدراسة هي عرض دقيق لأهم مبدأ من مبادئ دولة القانون الحديثة، ألا وهو مبدأ الأمن القانوني الذي يعد حقيقة قوام دولة القانون واستقرارها وثباتها، لما يضمنه من ثبات واستقرار في النظام القانوني بصفة عامة وللقواعد القانونية الجنائية بصفة خاصة، فالأمن القانوني ليس هدفه فقط الاستقرار في العلاقات والمراكز القانونية، بل غايته إشاعة الثقة والطمأنينة بين الأطراف العلاقات القانونية من أشخاص القانون العام والخاص بحيث يجب على التشريع أن لا يتسم بالمفاجئات أو التضخم في نصوص، ولهذا المفهوم عدة تجليات تظهر بصورة واضحة في التشريع الجنائي الجزائري وهو هدفنا من دراسة هذا الموضوع. وقد توصلنا في الأخير إلى أنه لا يمكن أن يكون هناك أمن قانوني في التشريعات بصفة عامة والتشريع الجنائي بصفة خاصة بنسبة مطلقة وإنما يبقي بشكل نسبي، وأن المشرع الجزائري عند إصداره للتعديلات المتعلقة بالجاني الجزائي لا يعني تضخم وإنما هو تدارك كل الهفوات والنقائص التي تضمنتها القوانين السابقة وذلك تماشيا مع التغيرات الاجتماعية الاقتصادية والسياسية التي تطرأ في البلاد This study is an accurate presentation of the most important principle of the modern state of law, namely, the principle of legal security which is the reality of the strength, stability and stability of the state of law, because it guarantees stability and stability in the legal system in general and the criminal legal rules in particular. Legal security is not only aimed at stability in Legal relations and centers, but rather the aim is to repulse confidence and reassurance between the parties, the legal relations of people of public and private law, so that the legislation must not be characterized by surprises or inflation in texts, and this concept has several manifestations that appear clearly in the Algerian criminal legislation, and it is our goal to study this topic. In the end, we concluded that there can be no legal security in legislation in general and criminal legislation in particular in an absolute percentage, but rather remains in relative terms, and that the Algerian legislator, when issuing amendments related to the criminal offender, does not mean inflation, but rather it corrects all the lapses and deficiencies contained in the previous laws This is in line with the socio- economic and political changes that are occurring in the country.
