فكرة النظام العام في النظام الدستوري الجزائري

Abstract

تُعالج هذه الدراسة فكرة النظام العام في النظام الدستوري الجزائري، وهي فكرة مرتبطة بالأسس التي يُبنى عليها المجتمع في مختلف جوانبه، فبعد أن استقر الفقه التقليدي على أن النظام العام يتضمّن ثلاثة عناصر أساسية هي: الأمن العام، الصحة العامة والسكينة العامة، تغيّر هذا المفهوم المادي واتّسع معناه ليشمل عناصر أخرى حديثة ذات طابع معنوي تبعًا لتطور الدولة وتنوّع نشاطها، مما جعل النظام العام يُساير هذا التوسّع حيث امتد مفهومه إلى المحافظة على الرونق الجمالي في المجال العمراني والنظام العام الإقتصادي وكذا النظام العام الخُلقي، كما دفع المؤسس الدستوري الجزائري إلى مواكبة التحولات الإقتصادية والإجتماعية من أجل المحافظة على النظام العام وفق الأسس السائدة في المجتمع وتوفير الحماية الدستورية لعناصره، وذلك من خلال تنظيم ممارسة الحريات العامة في إطار الضبط الإداري مع ما يتماشى مع مقتضيات المصلحة العامة وحماية الحياة في المجتمع.///////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////This study deals with the idea of public order in the Algerian constitutional system that is linked to the foundations on which society is built in its various aspects. After traditional case law established that public order includes three fundamental elements that are: public safety, health and tranquility, this material concept changed and broadened its meaning to include other modern elements of a moral nature according to the development of the State and the diversity of its activity. As a consequence, the public order broadened its concept to include the preservation of aesthetic splendor in the urban domain, to general economic order and to moral public order. It also urged the legislator of the Algerian Constitution to cope with socio-economic changes in order to preserve public order in accordance with the prevailing principles in society and to ensure the constitutional protection of its members, by regulating the exercise of public freedoms within the framework of administrative control in conformity with the requirements of the public interest and the protection of life in society.////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////Cette étude traite le concept de l'ordre public dans le système constitutionnel algérien, qui est lié aux bases sur lesquelles la société se construit dans ses différents aspects, la jurisprudence traditionnelle eut établi que l'ordre public comprend trois éléments essentiels: la sécurité publique, la salubrité publique et la tranquillité publique, cette notion matériel a été changée et élargie son sens pour inclure d'autres éléments modernes avec caractère moral, en fonction du développement de l'état et de diversification de son activité, ce qui a amené l'ordre public à s'adapter à cette expansion, où il a étendu sa notion à la sauvegarde du lustre de l'esthétique dans le domaine de l'urbanisme, l'ordre public économique et ainsi que dans l'ordre public moral, il a également incité le constituant constitutionnel algérien à suivre le rythme de l'évolution du concept économique et social, afin de maintenir l'ordre public selon les bases courantes dans la société et prévoir une protection constitutionnelle de ses éléments, en organisant l'exercice des libertés publiques dans le cadre de la police administrative conformément aux exigences de l'intérêt public et la protection de la vie de société.
