التعاون الدولي في مجال حماية الحق في البيئة -نحو تصور حديث لمقاربة الإنصاف الجيلي والاستدامة البيئية

Abstract

إن الطابع العالمي للبيئة ومشكلاتها، دفع جانبا من الفقه إلى القول بوجود طابع دولي لقانون حماية البيئة ولجينية الحق في البيئة، اعتقادًا منه بأن أكثريه المصادر التشريعية لهذا القانون والاساس القانوني لهذا الحق هي اتفاقيات دولية الأصل، وأن المصادر الموضوعية لهذا القانون هي قرارات صدرت عن المؤتمرات والمنظمات الدولية، فضلا عن بعض المبادئ الدولية التي ترسخ لهذا الحق، وأن أغلبية أنشطة الاعتداء على البيئة تتجاوز بطبيعتها حدود الدول، وأخطر هذه الأنشطة هي أنشطة الدول نفسها، وأن قواعد قانون البيئة تحصي بالدرجة الأولى مصلحة مشتركة تتعلق بالتراث المشترك للإنسانية، حيث تمتد آثار الملوثات المدمرة إلى العديد من الدول، وعليه فأية جهود رامية لحماية الحق في البيئة على المستوى الوطني بمعزل عن الجهود الدولية تبقى محدودة الفاعلية، خاصة اذا اعتبرنا أن محل هذا الحق ( البيئة) يمثل تراثا انسانيا مشتركا للجيل الحالي والجيل المقبل على حد السواء. .........................................................................................................................................
