آليات مكافحة الجرائم المتعلقة بالأسعار وفقا للقانون الجزائري

Abstract

تتمثل الآليات التي نص عليها المشرع الجزائري لمكافحة الجرائم المتعلقة بالأسعار في تجريم كل ممارسة تخل بقواعد ومبادئ شفافية ونزاهة الممارسات التجارية فنص على جنحة عدم الإعلام وكذا جرائم مخالفة أحكام الفوترة، وجريمة الإشهار التضليلي في كل من قانون الممارسات التجارية وقانون حماية المستهلك وقانون التجارة الإلكترونية، كما جرم ممارسة أسعار مجانية في السوق الإلكتروني كمخالة لأحكام حماية بيانات المستهلك الإلكتروني و كممارسة للبنود التعسفية في كل من قانون الممارسات التجارية وقانون التجارة الإلكترونية 18-05 باعتبارها ممارسة غير نزيهة، وكذا تجريم الممارسات الماسة بالأسعار في إطار القانون 21-15 المتعلق بمكافحة المضاربة غير المشروعة، وتجريم المضاربة غير المشروعة في قانون الممارسات التجارية عن كل سلوك من شأنه المساس بنزاهة وشرعية الممارسات التجارية، وحظر الممارسات الماسة بالأسعار في إطار قانون المنافسة. ونص على آليات متابعتها من خلال آليات أجهزة الإدارة في الإثبات والسلطات الإستثنائية الوقائية، والآليات الوقائية لمجلس المنافسة في ردع الجرائم المتعلقة بالأسعار، وآليات مجلس المنافسة، وسلطات الضبط القطاعية، وكذا رقابة مجلس قضاء الجزائر على القررات الصادرة عنه، وآليات القضاء العادي المدنية والجنائية في قمع الجرائم المتعلقة بالأسعار، والتي تتباين بتباين النصوص المجرمة وتختلف الإجراءات المتبعة أمامها، ويكون هناك إحالة أو تعاون بينها في حالات أخرى، وفي حالات أخرى نجد تداخلا بين إختصاصاتها في متابعة الجريمة .................................................................................................................
