الأمن القانوني كضمانة لحماية الموظف للأمر 06-03 المتضمن القانون الأساسي العام للوظيفة العمومية

Abstract

دولة القانون ماهي إلاّ تَمَظهر للأمن القانوني في صوره المتعددة ضمن مفهومه القاعدي، أو على مستوى المفاهيم الفرعية والجزئية المرتبطة به، ما تتهيكل في ظله أهداف هذه الدراسة؛ بحثا عن دور الأمن القانوني في ضمان حماية الموظف في بعده الموضوعي أو الذاتي والإجرائي، ضمن هندسة وتركيبة النظام القانوني للوظيفة العمومية، في ظل تكريس الأمن القانوني في التعديل الدستوري لسنة 2020، من خلال رصد صور الحماية واللاَّحماية، الأمن واللاأمن القانوني ضمن نطاق الخصوصية المرتبطة بالعلاقة اللائحية التنظيمية، المؤسس لها طبقا للأمر رقم 06-03 المتضمن القانون الأساسي العام للوظيفة العمومية والنصوص المرتبطة به، بتوظيف معيار التمكين والفعالية لمعرفة حدود الحماية القانونية، ومراعاة ضوابط هذه الحماية في صناعة القانون، وضمان جودته، معياريته، وفعاليته ومدى تحقيقه لعنصر الاستقرار والأمن للمركز القانوني للموظف، وضمانه لليقين والتوقع المشروع. ................................................................................................................................................. The State with the Rule of Law is nothing but a manifestation of legal security in its multiple forms, both within its core concept, or at the subordinate concepts associated with it, through which the purposes of this study are structured: id est. the quest for the role of legal security in guaranteeing employee protection in all forms: objective, subjective and procedural, under the legal system of the public service, and in light of the consolidation of legal security through the constitutional amendment of 2020, by monitoring the images of protection and non-protection, legal security and insecurity within the scope of the privacy associated with the organizational relationship, established in accordance with the ordinance N°: 06-03 on the General Statute of Public Service and texts associated with it, by setting up the criterion of empowerment and effectiveness to examine the limits of legal protection, as the process takes into account the norms of protection in law making, meanwhile, ensuring its quality, normativeness, effectiveness and the extent to which it secures the employee's legal position and it guarantees the certainty and legitimate expectation. ...................................................................................................................... L'État de droit n'est rien d'autre qu'une manifestation de la sécurité juridique sous ses multiples formes, tant au sein de son concept de base, qu'au niveau des concepts subordonnés qui lui sont associés, à travers lesquels les objectifs de cette étude sont structurés : id est. la quête pour le rôle de la sécurité juridique pour garantir la protection des fonctionnaires sous toutes ses formes : objective, subjective et procédurale, dans le cadre du régime juridique de la fonction publique, et à la lumière de la consolidation de la sécurité juridique par l'amendement constitutionnel de 2020, en surveillant les images de: protection et non-protection, sécurité et insécurité juridiques dans le cadre de la vie privée associée aux relations organisationnelle, établie conformément à l'ordonnance n°: 06-03 portant sur le statut général de la fonction publique et les textes qui lui sont associés, en mettant en place le critère d'autonomisation et d'efficacité pour examiner les limites de la protection juridique, car le processus prend en compte les normes de protection dans l'élaboration des lois, tout en garantissant sa qualité, son caractère normatif, son efficacité et la mesure dans laquelle il sécurise la situation juridique du fonctionnaire et garantit la certitude et les espérances légitimes
