Abstract

The present thesis’ topic sparked a lot of controversy that relates to the existing conflict between the two overlapping freedoms: the freedom of expression and the one of belief; in a world standing on contradictory ideologies. These are: on one hand, the Western liberalism that defends the negative concept of the freedom of expression and belief; and thoughts based on Justice, morality and protection of human beings dignity and belief as borders to the freedom of expression and belief on the other hand. The present research problem revolved around trying to understand the legal system which enshrines freedom of expression and belief, both at the local or international level; as well as its impact on the nature of the relationship between the two freedoms which form communication relations and contacts produced by globalization and affected by complex communication system, especially with the technological development for the world of informatics. The research has reviewed the impact of the political dimension on laws, including the freedoms of expression and belief having a negative meaning to achieve a democratic society according to the liberal Western concept. As a matter of fact, the liberal Western world tried to impose a universal meaning of the freedom of expression and belief according to its conception. This latter resulted in an internal struggle among individuals and institutions and an international struggle between communities and nations ..., creating a threat to security in all its dimensions and levels. The struggle was apparent in the conflict between the different communicative dimensions and the economic, social and cultural interaction. Thus, we shifted to a negative concept of freedom of expression and belief, and we tried to highlight the legal aspect in the organization of the indicators of restricting freedoms and the mechanisms for achieving it.
