الحماية القانونية للتراث الثقافي الجزائر

Abstract

في مجتمع تتغيّر فيه ظروف الحياة بسرعة متزايدة، لابدّ لتوازن الإنسان ونموه من أن يصانَ له محيطٌ ملائم يحيا فيه، ويظلّ على صلة بالطبيعة وبمعالم الحضارة التي خلقتها الأجيال الماضية. من هنا يأتي التراث الثقافي وأهميته الكبيرة في حياة الفرد والمجتمع. واعتباراً للقيمة المعنوية والمادية الكبيرة التي يحوزها التراث الثقافي، ونظراً لمختلف الأخطار والتهديدات التي يتعرّض لها، فقد أولى له المجتمع الدولي عناية كبيرة من خلال العديد من الجهود المتمثلة في الاتفاقيات والتوصيات والقرارات... التي قامت بها مختلف المنظمات الدولية الحكومية كاليونسكو والمنظمة العالمية للملكية الفكرية، وغير الحكومية اللجنة الدولية للصليب الأحمر واللجنة الدولية للدرع الأزرق، إضافةً الي الجهود الإقليمية كالجهود الأوربية والإفريقية والعربية... إن حماية التراث الثقافي وصونه وإحيائه مهمة كبيرة ومتطلبة تحتاج إلى تظافر الجهود الدولية والأنظمة الداخلية للدول وذلك لعدم كفاية الجهود الدولية لوحدها وهذا الذي غالباً ما تدعو إليه أغلب اتفاقيات حماية التراث الثقافي. والجزائر من بين الدول التي حباها الله تراثاً ثقافياً ثرياً ومتنوعاً يمتد منذ إنسان العصر الحجري، لهذا انخرطت في المساعي الدولية لحماية التراث وكان لها في بعض الأحيان دوراً مساهماً في خلق بعض اتفاقيات الحماية (اتفاقية حماية التراث الثقافي غير المادي)، ومصادقتها على كل هذه الاتفاقيات إضافةً الي جهودها الداخلية المتمثلة في سنها القوانين والتنظيمات المهتمة بحماية التراث والتي يأتي على رأسها القانون المتعلق بحماية التراث الثقافي، وكذا إنشائها لعدد كبير من المؤسسات والأجهزة المكلفة بحمايته وعلى رأسها وزارة الثقافة. رغم كل الجهود المبذولة من طرف الجزائر يبقى واقع التراث الثقافي في الجزائر مزرياً ومؤلماً يحتاج الى المزيد من الجهود والأعمال، والى وضع استراتيجية شاملة ومتماسكة تمكّن من الحماية الجيدة للتراث ولإحيائه وصونه خدمةً للفرد والمجتمع، وللأجيال اللاحقة وللإنسانية جمعاء. ....................................................................................................................................................................... Dans une société où les conditions de vie se transforment en croissance rapide ; il s’avère indispensable de maintenir un environnement convenable et vivable pour l’équilibre et le développement de l’être humain, qui le lie à la nature et aux jalons de la civilisation des générations passées ; ainsi vient le patrimoine culturel et sa grande importance dans la vie de l'individu et de la société. Vu les valeurs essentielles morale et matérielle qu’enrichissent le patrimoine culturel et compte tenu des divers dangers et menaces auxquels il est exposé, la communauté internationale lui a accordé une grande assistance grâce aux différents efforts de nombreuses conventions, des recommandations et des décisions dirigées par les diverses organisations internationales gouvernementales telle que l'UNESCO et l'Organisation mondiale de la propriété intellectuelle et non gouvernementale tel que le Comité international de la Croix-Rouge (CICR) et le Comité international du Bouclier Bleu, en plus des efforts régionaux européens, africains et arabes ... La protection du patrimoine culturel, sa préservation, et sa régénération est une lourde tâche qui nécessite des efforts internationaux concertés et des règlements internes des États, faute d’insuffisance d'efforts internationaux seuls, qui est l’objectif de la plupart des conventions de protection du patrimoine culturel, et l’Algérie est considérée parmi les pays que Dieu a doté d’un riche patrimoine culturel très varié qui s’étend depuis l’homme à l’âge de pierre , pour cela elle s’est engagé dans les efforts internationaux de la protection du patrimoine et a eu parfois un rôle contributeur dans la création de certains des accords de protection (Convention sur la protection du patrimoine culturel immatériel), et la ratification Sur chacun de ces accords. En plus de ces efforts internes de lois et règlements édictés concernés par la protection du patrimoine, vient en tête la loi sur la protection du patrimoine culturel, Ainsi que la création d'un grand nombre d'institutions et organismes chargés de sa protection et en particulier le ministère de la Culture. Malgré tous les efforts déployés par l'Algérie, la réalité du patrimoine culturel en Algérie reste désastreuse et douloureux et qui a besoin de plus d'efforts, de persévérance et d'élaborer une stratégie globale et cohérente pour lui permettre une bonne protection, le relancer et le préserver au service de la personne , de la société, des générations futures et de l'humanité entière. ............................................................................................................................................................................ In a society where living conditions change in an increasing speed, the balance and the growth of a human being must have an appropriate environment to live in, and to remain connected to nature and to the parameters of civilization created by pastgenerations. From here , the cultural heritage comes with its importance in the life of the individual and society . As the great moral and material value held by the cultural heritage, and due to various risks and threats , the international community has given a great care through a variety of efforts represented in conventions, recommendations and decisions ... which carried out by the various governmental and international organizations such as UNESCO and the World Intellectual Property Organization , and non-governmental International Committee of the Red Cross (ICRC) and the International Committee of the Blue Shield, in addition to regional efforts such as European, African and Arabic ones ... The cultural heritage protection and safeguarding and revive is an important demanded mission needs concerted international efforts and internal systems of the states, all that because of the the inadequacy of the international efforts alone, which is often called for in most of the cultural heritage protection agreements. Algeria is among the countries blessed by Allah with a rich and varied cultural heritage runs since the man of the Stone Age ; so that it has been engaged in the international efforts to protect the heritage and had sometimes a contributed role in creating some protection agreements (Protection of Intangible Cultural Heritage Convention), and its approval on all these agreements . In addition to its internal efforts of enacting laws and regulations concerned with the protection of heritage , comes on top the code related to the protection of cultural heritage, as well as creating a large count of institutions and agencies charged to protect it , led by the Ministry of Culture. Despite of all the efforts made by Algeria , the reality of the cultural heritage in Algeria remains terrible and painful , needs more efforts and work , and to be developed by a comprehensive and coherent strategy to enable a good protection for heritage to be revived and safeguarded to maintain service to the individual and society, to subsequent generations and humanity at large.
