الآليات الدولية لحماية التنوع البيولوجي في البحار

Abstract

تعاني البحار و المحيطات ـ باعتبارها قاعة الطعام العالميةـ من ضغوطات كثيرة أدت إلى انقراض الكثير من الأنواع البحرية و أخرى تواجه شبح الاندثار ، كانت النظرة منصبة على تلك الأنواع بمعزل عن الظروف المحيطة ، إلا أنه و بعد إدراك العالم لضرورة تبني رؤية شاملة قائمة على فكرة التنوع البيولوجي باعتباره مجمع ديناميكي من الكائنات الحية النباتية و الحيوانية التي تتفاعل كوحدة وظيفية ، تغيرت توجهات المجتمع الدولي نحو ادراج هذا المفهوم في كل الآليات التي من شأنها حماية البيئة البحرية ، إلا أن مفهوم التنوع البيولوجي يعتبر من المفاهيم الجديد في القانون الدولي ، هذا يعني أن هناك آليات لم تشر إليه مباشرة ، بل اكتفت بحماية أحد عناصر بشكل منعزل . تتعدد الآليات الدولية لحماية التنوع البيولوجي في البحار ، فهناك آليات ملزمة هي في الأساس المعاهدات و الاتفاقيات الدولية (الفصل الأول)، منها من تتسم بالعالمية و منها من تعنى بحماية نوع محدد على سبيل الحصر ، و أخرى تندرج ضمن رؤية إقليمية فرضتها المصلحة المشتركة و مقتضيات الجوار ، كما أن هناك آليات غير ملزمة (الفصل الثاني)و لاعتبارات قانونية و عملية ازداد تأثيرها في الساحة الدولية منها مدونات السلوك و الإعلانات و المبادئ و القرارات الدولية . و بين تلك الآليات الملزمة التي تتضمن بنود عامة و مجردة و التي تحتمل أكثر من تفسير ، و بين تلك الآليات المرنة التي تتبنى معايير تقنية تمتاز بالدقة و الوضوح لكن دون أثر ملزم ،تقع الدول التي يجب عليها أن تقرر بين هذه و تلك أو كلاهما ، و لكن بشرط بلوغ الغاية التي مفادها الوصول إلى حماية فعالة للتنوع البيولوجي في البحار ...................................................................................................................................................
