Abstract

شكّل صديق المحكمة ممارسة إجرائية نوعية في ضوء المحاكم الجنائية الدولية، ومحاكم حقوق الإنسان. حيث صار دوره فاعلا، إذ إنه يشارك ويؤثر برأيه وملاحظاته ومعلوماته أمام هذه المحاكم، وقد يدعى أو يأذن له القضاء بتقديم معلومات أو ملاحظات تسهم في تسوية النزاع. أصبح دوره المؤثر لافتاً في صياغة أحكام القضاء، لأنه يحظى بثقة القضاء والأطراف، كونه لا يستهدف تحقيق مصلحة شخصية، بل حماية مصلحة قانونية عامة. يبدي برأي أو بملاحظات أو بمعلومات قانونية وواقعية قد ترقى أحيانا إلى مستوى الأدلة المساعدة على معرفة الحقيقة. يضمن صديق المحكمة كآلية إجرائية الإدارة الحسنة العدالة، فلا ينحاز لأي طرف من أطراف النزاع حيث يقتصر دوره على الإجراءات، فلا علاقة له بموضوع النزاع................................................................................................................................................L’amicus curiae est un mécanisme procédural par lequel un tribunal invite ou autorise une personne ou une entité à participer à une instance existante entre des parties. Elle lui fournit des informations susceptibles d’éclairer son raisonnement. La participation de l’amicus curiae comme acteur de la société civile lui permet de s’associer à l’élaboration de décisions qui le concernent. Les règles proposées s’efforcent de donner les moyens aux tribunaux de trancher les litiges et de dire le droit dans des affaires mettant en cause des intérêts plus généraux que ceux des parties sans que les tiers ne puissent imposer leur présence dans les prétoires...............................................................................................................................................The amicus curiae is a procedural mechanism by which a court invites or authorizes a person or entity to participate in an existing instance between parties. It provides it with information that could help in settling the disputes. The participation of amicus curiae as a civil society actor to be involved in the elaboration of decisions concerning them. The proposed rules seek to empower the courts to settle disputes and to state the law in cases involving broader interests than those of parties without, that third parties can impose their presence in the courtroom.
