dc.description.abstractAbstract:During the operation of the ship, it is likely to face several situations and legal relationships. In this sense, it is very common to identify one or more elements of foreignness, and therefore to distinguish the birth of a legal relationship that links maritime law with private international law. It is in this regard that we wonder about the particularism and the role of certain conflicting rules which appear either before the designation of the applicable law or after its designation, in particular the qualification (the lex rei sitae), the fraud to the law and conflict mobile. A descriptive, comparative and analytical methodology was carried out to determine the scope of the above mechanisms with the Ship. Résumé : Lors de l’exploitation du navire, celui-ci est susceptible de faire face à plusieurs situations et rapports juridiques. En ce sens, il est très commun de relever un ou plusieurs éléments d’extranéités, et par conséquent distinguer la naissance d’un rapport juridique qui lie le droit maritime avec le droit international privé. C’est à cet égard qu’on se demande sur le particularisme et le rôle de certaines règles conflictuelles qui se manifestent soit avant la désignation de la loi applicable soit après sa désignation, notamment la qualification (la lex rei sitae), la fraude à la loi et le conflit mobile. Une méthodologie descriptive, comparative et d’analyse a été effectuée afin de déterminer la portée des mécanismes précités avec le navire.en_US
