الضمانات الدستورية والقانونية لنزاهة عملية التسجيل في القوائم الانتخابية في الجزائر

Abstract

تجسد الانتخابات الوسيلة الديمقراطية الأمثل لمشاركة المواطنين في تسيير شؤونهم العامة وتعبيرهم عن قناعاتهم وخياراتهم بكامل حرية واستقلالية، ويظهر ذلك خصوصا من خلال عملية انتخابية نزيهة شفافة بكامل مراحلها، يتم فيها احترام الضوابط والنصوص القانونية المنظمة لإجرائها من كافة الأطراف. ومرحلة التسجيل بالقوائم الانتخابية هي واحدة من أهم إجراءات العملية الانتخابية، والتي تنعكس آثارها وطريقة تنظيمها على كافة المراحل اللاحقة، كما أنها شرط شكلي ضروري لممارسة الحق في الانتخاب إلى جانب الشروط الموضوعية الأخرى المحددة قانونا. وإدراكا من المشرع بحساسية هذه المرحلة وأهميتها، فقد أحاطها بمجموعة ضمانات دستورية وقانونية، تدعمت من خلال التعديل الدستوري 2016 والقانون العضوي 16-10 المتعلق بنظام الانتخابات، وتهدف أساسا لحمايتها من كافة أشكال التلاعب والتزوير التي قد تشوبها، ما يؤثر على سلامة ونتيجة العملية الانتخابية بأكملها، ويمس بإرادة الناخبين وتوجهاتهم. .................................................................................................................................................... Les élections restent le meilleur moyen démocratique qui assure aux citoyens de participer à la gestion de leurs affaires générales et exprimer leurs choix et leurs convictions, en toute liberté et indépendance. Elles se confirment par sa transparence au cours des divers étapes, tout en respectant la réglementation par tout les participants. Les inscriptions dans les listes électorales constituent une des plus importantes étapes de ces élections. Elles conditionnent l’acte d’exercice du droit électifs. Le législateur à accordé une grande importance à cette étape très sensible en donnant des garanties constitutionnelles et juridiques, renforcées par la dernière rectification constitutionnelle 2016, et la loi 16-10 concernant la réglementation des élections, dans le but de la protéger de la fraude, ou de tout autre acte qui pourra dévier la volonté, le choix des électeurs et le résultat des élections. .................................................................................................................................................... The elections are the best democratic way for the citizens to participate in the management of their daily life and business and therefore to express themselves and their choice and convictions with freedom and independence. All these could be done and realized by a clean and transparent election all along its steps by respecting the laws by everyone. One of the most important steps of these elections is the step of inscription in the electoral lists. It is one of the conditions which permits to the citizens to exercise their elective rights besides other conditions. That’s why, the law-maker has given a great importance to this step which is very sensitive by giving constitutional and judicial warranties which were reinforced during the last rectification of 2016 and the organic law 16-10 which concerns the regulations of the elections in order to protect it from the fraud and from any other act which may change the choice, the will of the electors.
