تدابير العفو عن انتهاكات حقوق الإنسان والقانون الدولي الإنساني المطبق على النزاعات المسلحة غير الدولية: بين مبرّرات المصالحة الوطنية ومتطلبات إنفاذ العدالة.

Abstract

تتناول الدراسة بالبحث والتمحيص موضوع تدابير العفو عن انتهاكات حقوق الإنسان، والقانون الدولي الإنساني المطبق على النزاعات المسلحة غير الدولية، في محاولة لضبط كيفيات استخدام تدابير العفو، على نحو يدفع المصالحة والسلم إلى الأمام، دون إهمال ضرورات إنفاذ العدالة المنصوص عليها في أحكام القانون الدولي، والتي تفرض عدم إطلاق سلطة الدول في تبني هذا النوع من التدابير. وقد خلصت الدراسة إلى أن: تدابير العفو اعتمدت بالفعل في أكثر من تجربة لتثبيت دعائم المصالحة الوطنية، بل واعتبرت في بعض الحالات المنفذ الوحيد لتحقيق تلك المصالحة، كما ثبت أنه لا يوجد صك اتفاقي دولي يحظر رسميا تلك التدابير الوطنية. ومع ذلك فإن تبنّي مثل هذه التدابير لم يعد خاضعا حصرا للسلطة التقديرية الواسعة للدول، إذ تدخلت مجموعة من القواعد والمبادئ الأساسية في القانون الدولي لتضبط نطاق تدخل الدولة وحدود سلطتها في هذا المجال. وأصبح من المعترف به أن تدابير العفو التي تمنع مقاضاة أفراد قد يتحملون المسؤولية القانونية عن ارتكاب جرائم حرب، أو إبادة جماعية، أو جرائم ضد الإنسانية، أو غير ذلك من الانتهاكات الجسيمة لحقوق الإنسان، متنافية مع التزامات الدول الاتفاقية، فضلاً عن تنافيها مع قواعد القانون الدولي العرفي والسياسة العامة للأمم المتحدة.///////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////L'étude examine le sujet des mesures d'amnistie traitant de les violations des droits de l'Homme et du droit international humanitaire, afin de déterminer les modalités d'utilisation ces mesures d'amnistie de manière à permettre la réconciliation et la paix sans pour autant négliger les impératifs de mettre en œuvre la justice comme les dispositions de droit international les imposent. Ainsi dit, les mesures d'amnistie ont déjà été adoptées dans de nombreux cas dans le cadre de la mise en œuvre du processus de réconciliation. En sens juridique propre, aucun instrument international n’interdit officiellement ces mesures nationales, mais à l’encontre, ses dernières sont soumises à un ensemble de règles et de principes fondamentaux du droit international. ///////////////////////////////////////////////////////////////////////////////////////////////////////////////////////The study examines the topic of amnesty measures for violations of human rights and international humanitarian law. The aim behind that is to determine the modalities for using amnesty measures in a way that allows reconciliation and peace without neglecting the imperatives of enforcing the justice stipulated in the provisions of international law. The study concluded that amnesty measures were already adopted in many cases within the framework of implementing reconciliation processes, as it has been proven that there is no international instrument that officially prohibits these national measures. However, the adoption of such measures is no longer subject exclusively to the broad discretionary power of states, amnesties are now regulated by a substantial body of international law.
