حماية حقوق الإنسان للأطفال المهاجرين غير المصحوبين في القانون الدولي

Abstract

يعتبر الأطفال المهاجرين غير المصحوبين أحد أوجه الضعف في الهجرة الدولية، وهذا بسبب العديد من الدوافع والأسباب المرتبطة أساسا بتدهور مستويات التمكين والانتفاع من حقوق الإنسان في البلدان المنشأ، وبسبب حالتهم الهشة؛ يتعرضون أيضا لأوجه متنوعة من العنف أثناء تواجدهم بدول العبور أو المقصد، فيكونون ضحايا لانتهاكات حقوق الإنسان من مختلف الفواعل دولا كانوا أو أفرادا، تمس مباشرة المصالح الفضلى للطفل، حيث إن الدول المعنية بهذه الظاهرة مسؤولة عن حمايتهم منها، وفقا للمبادئ والالتزامات القانونية المنوطة بها في القانون الدولي، فالآليات الدولية الحكومية –سواء الأجهزة الرئيسية للأمم المتحدة أو الفرعية أو اللجان التعاهدية أو الوكالات المتخصصة-تشكل إحدى أهم الوسائل التي تراقب مدى التزام الدول بتنفيذ التزاماتها الدولية في مجال حماية حقوق الإنسان للأطفال المهاجرين غير المصحوبين.//////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////Les enfants migrants non-accompagnés sont considérés comme une des figures de la vulnérabilité au sein de la migration internationale et ce, en raison des nombreux facteurs et causes liés principalement à l’absence et à la dégradation des droits de l'homme dans leur pays d'origine. En raison de leur fragilité, ils sont exposés à diverses formes de violence lorsqu'ils se trouvent dans des pays de transit ou de destination, de sorte qu’ils sont victimes de violations des droits de l'homme commises par différents acteurs tels que des états ou des individus. Cela qui affecte directement l'intérêt supérieur de l'enfant, de sorte que tous les pays concernés par ce phénomène est sont responsables de les protéger leur protection conformément aux principes engagements et obligations juridiques édictés par le droit international. Ainsi, les mécanismes internationaux qu’ils soient des organes principaux des Nations Unies, ou des sous-comités, ou des traités ou des institutions spécialisées, constituent l'un des moyens les plus importants de contrôle de l’engagement des états à faire respecter les obligations internationales dans le domaine de la protection des droits de l'homme pour les enfants migrants non-accompagnés.///////////////////////////////////////////////////////////////////////////////////////////////////////////////////Unaccompanied Migrant Children are considered to be one of the weaknesses within International Migration, because of many reasons related primarily to the deterioration of empowerment levels, and the enjoyment of Human Rights in the Origin Countries , as well as their vulnerable situation; they are also exposed to various forms of violence while they are in Transit or Destination Countries, so they become victims of Human Rights Violations committed by different actors such as States or individuals, which affect directly the best interests of the Child. thus, all concerned States are responsible to protect children from this phenomenon, in accordance with the principles and legal obligations imposed on them by the International Law. The international governmental mechanisms -whether principal bodies of the United Nations or sub-committees or treaties or specialized agencies-is one of the most important means of monitoring the extent of the States commitment to enforce their international obligations in the Protection of the Human Rights of Unaccompanied Migrant Children.
