منازعات الأحزاب السياسية: دراسة مقارنة -الجزائر ، المغرب، مصر

Abstract

تلجأ الدول إلى تنظيم ممارسة الحرية الحزبية على غرار باقي الحريات حتى تضمن ممارسة الحرية دون المساس بالنظام العام، وهذا ما ذهبت إليه كل من (الجزائر، المغرب، مصر) من خلال وضع نظام قانوني خاص بالأحزاب السياسية يضبط بموجبه تأسيسها، نشاطها والمنازعات التي قد تثور بشأن تطبيق هذا القانون. ونظرا لخصوصية المنازعة الحزبية سواء من حيث طبيعتها لتعلقها بحق من الحقوق السياسية المكفولة دستوريا، أو من حيث أطرافها، إذ غالبا ما يكون بين الحزب والجهة المكلفة بمتابعة النشاط الحزبي، هذه الأخيرة التي قد تكون جزء من الحكومة القائمة، مما يتوجب إسناد مهمة الفصل فيها لجهة قضائية قادرة على إعادة التوازن بين طرفي المنازعة، وذلك لا يمكن تحقيقه من غير اللجوء للقاضي الإداري. إن الهدف من هذه الدراسة هو الإحاطة بكافة النزاعات التي تصادف الحزب السياسي سواء قبل تأسيسه أو بعده -أثناء نشاطه- في كل من (الجزائر، المغرب، مصر)، سواء تلك الواردة في قانون الأحزاب أو في قوانين لها علاقة به، ومدى توفيق الدول محل الدراسة في إعطاء ضمانات كافية لإعادة التوازن بين طرفي النزاع الحزبي. أين توصلنا في نهاية المطاف، ورغم إجماع الدول محل الدراسة على خضوع القرارات المتعلقة بالأحزاب السياسية لرقابة القاضي الإداري، إلا أنه توجد بعض الثغرات القانونية التي لا تخدم الأحزاب السياسية، الأمر الذي تم استغلاله من قبل الإدارة لضرب الأحزاب السياسية، خاصة منها تلك التي يكون خطها مخالفًا لخط الحكومة القائمة. ................................................................................................................................................................... States resort to organize the exercise of partisan freedom in the same way as thee freedoms in order to guarantee the exercise of freedom without prejudice to the public order, this is what each of (Algeria, Morocco and Egypt) went to by putting in place a legal system for political parties that controls their establishment, their activities, and the disputes that may arise regarding the application of this law. And in view of the peculiarity of the partisan dispute, whether in terms of its nature as it relates to one of the political rights guaranteed by constitution, or in terms of its parties, as it is often between the party and the party charged the following up, the parley's activity, the latter that may be part of assisting government, which must be assigned to a judicial body capable of restoring the two parties to the dispute, and this can not be achieved without restarting to the administrative judge. The aim of this study is to take note off all the conflicts that a political party faces, whether before its establishment or after it –during its activity- in (Algeria, Morocco and Egypt), whether those contained in the political parties law or in laws related to it, and the extent to which the countries under study are reconciled in giving adequate guarantees to restore balance between the two parties to the partisan conflict, where did finally reach, and despite the unanimous agreement of the countries under study that decisions relating to you with political parties are subject to the control of the administrative judge, but there are some legal loopholes that de not serve political parties, the matter that has been exploited by the administration to hit the political parties, especially those whose line contradicts the line of the existing government.
