الوساطة القضائية في المواد الإدارية

Abstract

تخضع الوساطة القضائية لأحكام مشتركة سواء أمام القضاء العادي أو قضاء الإدارة مبدئيا، ويكمن تفعيلها في كل دعاوى الإدارة باستثناء تلك التي تثير مشكل الاختصاص الإداري لأنه من النظام العام ولا يجوز الاتفاق على مخالفته سواء كان النزاع معروض أمام المحاكم الإدارية أو أمام مجلس الدولة، كما لا يجوز تفعيلها بالنسبة للدعاوى المرفوعة أمام مجلس الدولة باعتباره قاضي أول و أخر درجة Subject to judicial mediation with the provisions of common both in front of the ordinary courts or spend management initially, and is activated in all cases administration except those that give rise to the problem of administrative jurisdiction because of public order may not agree on the violation, whether the dispute is before the administrative courts or in front of the State Council, as no may be activated for claims filed before the Council of State as a judge of the first and the last degree.
