إشكالية الاختصاص القضائي في ظل قانون الجنسية المغربي

Abstract

تهدف هذه الدراسة إلى تفكيك النظام القانوني المتعلق بالاختصاص القضائي في منازعات الجنسية المغربية من خلال إبراز كيفية توزيع الاختصاص القضائي من طرف المشرع المغربي بين القضاء العادي، باعتباره صاحب الولاية العامة، والقضاء الإداري الذي يفصل في المقررات الإدارية المتعلقة بالجنسية. بالإضافة إلى ذلك، عالج هذا البحث خصوصيات ازدواج القضاء في نظر منازعات الجنسية من خلال بيان قواعد الاختصاص الترابي والنوعي، وتحديد كافة صور الدعاوى القضائية الناشئة عن منازعات الجنسية وآثارها القانونية على المركز القانوني لمؤسسة النيابة العامة من جهة، وحجية الأحكام الصادرة في نطاق تلك الدعاوى القضائية من جهة أخرى. This study aims to deconstruct the legal system of jurisdiction in Moroccan nationality disputes, by highlighting how this jurisdiction is distributed by the Moroccan legislator, between the ordinary judiciary, as the holder of public jurisdiction, and the administrative judiciary, which determines the administrative decisions on nationality. In addition, this research addressed the specificities of dual jurisdiction to examine the nationality disputes, through the illustratation of rules governing the territorial and substantive judicial competence. The identification of all forms of judicial proceedings arising from nationality disputes, as well as their legal effects on both; legal status of the public prosecutor's office, and the authority of judgments in those judicial proceedings is also relevant.
