ضمانات حرمة الحياة الخاصّة أثناء إجراءات مُراقبة الاتصالات الإلكترونية

Abstract

على غرار الكثير من التشريعات في العالم، نظّم المُشرّع الجزائري في قانون الإجراءات الجزائية وقانون مكافحة جرائم تكنولوجيا الإعلام والاتصال إجراء مُراقبة المُراسلات والاتصالات الإلكترونية عبر شبكات الانترنت ووسائل الاتصال عبر الأقمار الصناعية، كأسلوب للتحرّي والتحقيق في بعض الجرائم الخطيرة، مثل الإرهاب والجريمة المنظمة والمخدرات والفساد وتبييض الأموال، والجرائم المعلوماتية التي تتّخذ المنظومة المعلوماتية وشبكات التواصل وسيلة إجرامية أو هدفًا إجراميًا. ومن أجل ضمان عدم انتهاك خصوصية وسرّية الاتصالات الالكترونية، فقد قيّدها بشروط موضوعية تتعلّق بطبيعة الجريمة وضرورات التحرّي والتحقيق وبطبيعة الأشخاص الخاضعين له، وشروط إجرائية لترخيص المُراقبة وتنفيذها، تتعلّق بخضوعها لإشراف ورقابة القضاء واحترام حقوق الدفاع. Abstract: Like many legislations in the world, the Algerian legislator in the Criminal Procedures Law and the Law on Combating Media and Communication Technology Crimes has regulated the procedure for monitoring correspondence and electronic communications via the Internet and means of communication via satellite as a method for investigating and investigating some serious crimes such as terrorism, organized crime, drugs, corruption, money laundering, and information crimes Those that take the information system and communication networks as a criminal means or as a criminal objective. In order to ensure that the privacy and secrecy of electronic communications are not violated, it has restricted them with objective conditions related to the nature of the crime, the necessities of investigation and investigation, the nature of the persons subject to it, and procedural conditions for the licensing and implementation of surveillance related to its subjection to the supervision and control of the judiciary and respect for defense rights.
