تقييد تأسيس البنوك والمؤسسات المالية الخاصة في الجزائر

Abstract

يخضع نشاط تأسيس البنوك والمؤسسات المالية في الجزائر لأحكام الأمر رقم 03-11 المتعلق بالنقد والقرض، ويهدف هذا البحث لمحاولة معرفة مدى قدرة النصوص القانونية الحالية المنظمة للقطاع المصرفي في تشجيع وتحفيز المستثمرين المصرفين الجزائريين أو الأجانب على تأسيس بنك ومؤسسة مالية وإقامة فرع بنك ومؤسسة مالية أجنبية في ظل الشروط والإجراءات المطلوبة خاصة وأن النشاط المصرفي يلعب دورا كبيرا في التنمية الإقتصادية وفي توفير السيولة النقدية وكذا توفير المدخرات وتحويلها إلى قروض إستثمارية، مما يستدعى التدخل من قبل المشرع من أجل فرض أحكام قانونية جديدة تتماشى مع مبدأ حرية الإستثمار المكرس في التعديل الدستوري الأخير لسنة 2016. The activity of building banks and financial institutions in Algeria is submitted to the provisions of currency and credit ordinance n°03-11,this research aims to try to make known the strength and capacity of the current banking legal texts which organize the banking sector in order to encourage the Algerian and foreign banking investors to the construction of a bank, a financial institution and install a branch of a bank of foreign financial institution under the conditions and procedures required, especially since the banking activity plays a very important role in economic development and also in providing monetary liquidity and the provision of savings and it's conversion into investment loans, which require the intervention of the legislator to impose new provisions aligned with the principle of freedom of investment enshrined in the last revision of the constitution in 2016.
