المسؤولية الجزائية عن الأضرار البيئية

Abstract

تناولنا في هذا الدراسة موضوع في غاية الأهمية تحت عنوان المسؤولية الجزائرية عن الاضرار البيئية، حيث تم تقسيم الخطة إلى بابين ، الباب الاول جاء تحت عنوان المسؤولية الجزائية عن الاضرار البيئية في القانون الدولي من خلال فصلين، حيث تم تحددي مفهوم و أسس المسؤولية الدولية عن الضرر البيئي خاصة الفعل غير المشروع كأساس لها وكذلك الخطأ والضرر، ثم تطرقنا الى المسؤولية الدولية الجنائية للفرد عن الجريمة البيئية حيث أصبح طرف في علاقة دولية يمتلك الشخصية القانونية الدولية ويعاقب على جريمة تلويث البيئة. أما في الباب الثاني تطرقنا الى ماهية المسؤولية الدولية الجنائية في التشريع الجزائري، و قمنا بتحديد ماهية المسؤولية الجنائية الدولية للشخص الطبيعي و الشخص المعنوي عن الجريمة البيئية.حيث اعترف القانون الجزائري بالمسؤولية الجزائية للأشخاص المعنوية عن الجريمة البيئية وهي الاشخاص التابعة للقطاع الخاص فقط في حين استثنى صراحة الأشخاص المعنوية العامة ونؤكد على دور الجزاء الجنائي في حماية البيئة ،من خلال اقرار عقوبات جد مشددة ، ومنها عقوبة الاعدام و السجن الى الغرامات. /////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////// In this study, we dealt with a very important topic under the title of Algerian responsibility for environmental damage, where the plan was divided into two doors, the first chapter came under the title of criminal responsibility for environmental damage in international law through two chapters, where the concept and foundations of international responsibility were determined on harm Environmental, especially the illegal act, as its basis, as well as error and harm, then we touched on the international criminal responsibility of the individual for the environmental crime, as it became a party in an international relationship that possesses the international legal personality and punishes the crime of polluting the environment. In Chapter Two, we touched on what is the international criminal responsibility in Algerian legislation, and we have identified what is the international criminal responsibility of the natural person and the moral person for environmental crime. The Algerian law recognized the criminal responsibility of moral persons for environmental crime, which is the people affiliated with the private sector only while excluding Frankly, public moral persons, and we emphasize the role of criminal penalty in protecting the environment, by approving very strict penalties, including the death penalty and imprisonment to fines.
