عقود الشراكة بين القطاع العام والخاص في تسيير المرافق العمومية المحلية

Abstract

يُعتبر اصطلاح الشراكة بين القطاعين العام والخاص أبرز مخرجات التطور الحاصل على صعيد السياسات الرامية لتحسين أداء جودة المرافق العمومية الوطنية والمحلية على وجه الخصوص، الأمر الذي يماهم بشكل خاص ومباشر في تحقيق أفضل خدمات مقدمة للجمهور والمواطنين، حيث تشكل مشاركة القطاع مشاركة القطاع الخاص للحكومة في تقديم خدمات نمطاً جديداً ومنهجا في الاستثمار، والتي تهدف وبالدرجة أولى الى تخفيف العبء عن الموازنات العامة. كما تم التعرض لفعالية عقود الشراكة بين القطاعين العام والخاص في استغلال المرافق العمومية المحلية، بالتعرض لمختلف المبررات والاهداف، واستكمالأ لذلك تم التطرق لنوعين مهمين من العقود المستخدمة في الجزائر، فقد تم اعتماد عقد الامتياز وعقد التفويض كألية لتسيير المرافق العمومية المحلية، وذلك لسهولة اجراءاتهم مقارنة بأنواع العقود الأخرى. ............................................................................................................................................................. The term partnership between the public and private sectors is considered the most prominent output of the development taking place in terms of policies aimed at improving the performance of the quality of national and local public utilities in particular, which contributes directly and specifically to achieving the best services provided to the public and citizens, as the participation of the sector constitutes the participation of the private sector to the govemment in providing Services provide a new pattern and methodology for investment, which aims primarily to reduce the burden on public budgets. The effectiveness of partnership contracts between the public and private sectors in the exploitation of local public utilities was also discussed, by addressing the various justifications and objectives, and as a complement to that, two important types of contracts used in Algeria were addressed other types of contracts.
