حقوق الطفل المعاق بين الدولية وواقع التطبيق الجزائري

Abstract

الطفل المعاق كونه العتبة الأولى لتنمية شخصية الفرد، ومحور اهتمام الأسرة الدولية؛ فقد سعت هذه الأخيرة إلى ضمان حقوقه دونما أي تمييز، وهذا بسن ترسانة من المواثيق الدولية العالمية والإقليمية، وعززتها بآليات تكفل التطبيق الحسن لهذه الصكوك على أساس المساواة والكرامة الإنسانية. أولت الجزائر منذ استرجاع سيادتها الوطنية أهمية كبيرة لحقوق الطفل المعاق، باعتباره أهم فئة من فئات المجتمع التي تحتاج إلى الرعاية والحماية، فأصدرت القانون 02-09 الذي شكل نقلة نوعية في سبيل تمكين الطفل المعاق من أهم حقوقه وتنمية قدراته من أجل إدماجه في الوسط المدرسي والمهني واندماجه في المجتمع، غير أنه وبالرجع للواقع التطبيقي نجد الكثير من الثغرات التي تكتنف التطبيق الجيد الذي يمكن الطفل المعاق من حقوقه، إلا أن الجزائر ماتزال تبذل مجهودات من أجل تنفيذ التزاماتها الدولية من خلال التطبيق الحسن للقوانين وتمكين الطفل المعاق من حقوقه. ........................................................................................................................................................................ Pour que la commission internationale se concentre sur lui afin de garantir ses droits sana discrimination, Promulgation et renforcement d’un arsenal d’instruments internationaux mondiaux et régionaux avec des mécanismes pour assurer la bonne mise en œuvre de ces instruments sur la base de l’égalité humaine . Depuis l’indépendance de l’Algérie, a accordé une grande attention au droit des enfants handicapés ; parce que son une catégorie importante de la société dans le besoin de soins et de protection. Promulgué la loi 02-09, permettant aux enfants handicapés d’avoir leurs droits et de développer leurs capacités à être intégrés dans la société .Cependant, les réalités pratiques de la loi trouvent de nombreuses lacunes qui empêchent une bonne application et privent un enfant handicapé de ses droits. L’Algérie continue de déployer des efforts pour mettre en œuvre ses obligations internationales en appliquant correctement les lois et en autonomisant les enfants handicapés. ......................................................................................................................................................................... Since Independence Algeria, has paid great attention to the right of children with disabilities; because its one of important category of society in need of care and protection. Promulgated the law 02-09, enabling disabled children to have their rights and develp their capacities to be integrated into society. However, the paractical realities of the law find many gaps that prevent good application and deprive a disabled child of his or her rights. Algeria continue to make efforts to implement its international obligations through the proper application of the laws and the empowerment of children with disabilities.
