مسؤولية إعمال الحق في الغذاء

Abstract

إن الحق في الغذاء الذي يعد من بين أهم حقوق الإنسان يحتاج إلى تفعيل العديد من الالتزامات لإعماله بالشكل التام، ومن تلك الالتزامات التي لها الطابع الداخلي والتي لها الطابع الدولي، ومدى احترام الدول والأفراد لتلك الالتزامات هو ما يؤكد الإعمال التام للحق في الغذاء من عدمه، فإن لم يكن هناك احترام وتطبيق لتلك الالتزامات سيكون هناك بالتأكيد انتهاك للحق وعدم تمكين الأفراد منه وهو الأمر الذي يستدعي إقامة المسؤولية على المنتهك أمام القضاء الوطني بمنح حق التقاضي للأفراد وحق المطالبة بحقهم أمام الجهات القضائية الداخلية، بل والسماح للدولة والفرد بالتقاضي أمام الجهات القضائية الدولية ومنح الحق في الغذاء المكانة التي يجب أن يكون عليها كباقي حقوق الإنسان وهو أن يكون حق عالمي محمي من قبل أعلى الجهات القضائية الدولية. فتفعيل المسؤولية الدولية في حالات انتهاك الحق في الغذاء لهي مطلب عالمي تسعى مختلف الهيئات الدولية للوصول إليه وتحقيقه، حتى يتحقق الوصول وإعمال الحق في الغذاء وباقي حقوق الإنسان. .............................................................................................................................................................. The right to food is one of the most important human rights that requires the full realization of many obligations. Among these obligations, those which are of an internal and international nature; and the extent to which States and individuals respect them is what confirms the full realization of the right to food or not. If there is no respect and implementation of these obligations, there will certainly be a violation of the right and the failure to empower individuals from it. This requires establishing responsibility on the violator before the national judiciary by granting the right to litigate to individuals and the right to claim their right to food before the internal judicial authorities; and even allowing the State and the individual to litigate before International judicial authorities and granting the right to food the value it must have as all other human rights, which is to be a universal right protected by the highest International judicial authorities. The activation of international responsibility in violations’ cases of the right to food is a universal requirement that different international authorities seek to reach and achieve, in order to achieve access and the realization of the right to food and other human rights.
