الأساس القانوني لتمتع الأجانب بالحقوق في ضوء القانون: رقم 08-11 المتعلق بشروط دخول الاجانب إلى الجزائر وإقامتهم بها وتنقلهم فيها

Abstract

إذا كان الاهتمام الواسع بتطوير و حماية حقوق الإنسان في المجتمع الدولي قد أثر بشكل إيجابي على مسلك الجزائر في معاملة الأجانب على إقليمها على غرار دول العالم، حيث أصبحت مسألة الاعتراف لهم بالشخصية القانونية، و ما تقتضيه هذه الأخيرة من ضرورة تقرير حقوق لهم في نظمها القانونية مسألة مسلم بها، فإن التمتع بهذه الحقوق يبقى مرهونا بمدى توفر الأسس القانونية التي تسمح للأجنبي بالمطالبة بها على الإقليم الجزائري، و هي التي تتعلق في المقام الأول بممارسة الجزائر لسيادتها على إقليمها في تنظيم حقوق الأجانب أخذة بعين الاعتبار التزاماتها الدولية و مصالحها المختلفة، و تتعلق في المقام الثاني بتواجد الأجنبي على الإقليم الجزائري تواجدا مشروعا، و ذلك باحترام الشروط القانونية التي يمليها القانون 08-11 المتعلق بشروط دخول الأجانب إلى الجزائر و إقامتهم بها و تنقلهم فيها. ...................................................................................................................................................................... If the widespread interest in the development and protection of human rights in the international community has had a positive impact on Algeria’s orientation in treating foreigners on its territory like the countries of the world, where the issue of recognizing them as a legal personality and the necessity of determining their rights in its legal systems have become a matter taken for granted, the enjoyment of these rights remains subject to the availability of the legal grounds that allow foreigners to claim them on Algerian territory. They relate primarily to Algeria’s exercise of sovereignty over its territory in regulating the rights of foreigners, taking into account its international obligations and various interests. Secondly, they relate to the foreigner’s lawful presence in Algerian territory by respecting the legal requirements of Act No. 08-11 on the conditions of entry, residence, and movement of foreigners in Algeria.
