دور الرشادة البيئية في تكريس الحق في البيئة

Abstract

إن حقوق الإنسان لا تترتب فقط بالنظر إلى الإنسان كشخص، وإنما أيضا تترتب من خلال علاقته بالمجتمع وبالمحيط الذي يعيش فيه على اعتبار أنه جزء لا يتجزآ منه، في هذا السياق تولد حق جديد من حقوق الإنسان المسماة بحقوق التضامن وهو الحق في البيئة الذي عرف جدلا فقهيا حول مضمونه وسبل حمايته والتحديات التي تواجه تكريسه، خاصة ما تعلق منها بالمجال التنموي الذي أغفل إلى حد كبير حماية البيئة باعتبارها إرثا إنسانيا مشتركا الأمر الذي أدى إلى ظهور مفهوم جديد يسعى إلى إحداث التوازن في معادلة البيئة والتنمية من خلال تحقيق تنمية اقتصادية بأقل قدر ممكن من الأضرار البيئية انطلاقا من مبادئ المساءلة والشفافية ودولة الحق والقانون. إذن يسعى هذا المقال إلى تحليل أثر الرشادة على البيئة،ودراسة دور الرشادة البيئية في تكريس الحق في البيئة كحق من حقوق الإنسان الأساسية. .................................................................................................................................................. Les droits de l’homme ne s’appliquent pas uniquement à l’homme en tant que personne, mais s’appliquent aussi à travers sa relation avec la société et l’environnement au sein duquel il vit, au motif qu’il fait partie intégrante de cet environnement, que dans ce contexte est né un nouveau droit des droits de l’homme dits droits de solidarité qui est le droit à l’environnement qui a connu une polémique doctrinale concernant son contenu, les moyens de sa protection et les défis auxquels est confrontée sa consécration, notamment en ce qui concerne le domaine du développement qui a omis dans une large mesure la protection de l’environnement en tant qu’héritage commun de l’humanité, ce mené à l’émergence d’un nouveau concept qu’est la rationalisation environnementale qui vise à créer un équilibre dans l'équation de l'environnement et du développement à travers la réalisation d’un développement économique avec les moindres éventuels dommages environnementaux à partir des principes de la responsabilisation, la transparence et la primauté du droit. Donc, cet article cherche à analyser l'impact de la rationalisation environnementale et l'étude de son rôle dans la consécration du droit à l'environnement comme une question de droits fondamentaux. ................................................................................................................................................. So, this article is to analyze the impact of environmental rationalization and study its role in the consecration of the right to the environment as a matter of fundamental rights.
