الكاريكاتير بين الحق في الإعلام والحق في الصورة -تداعيات أزمة الرسوم بين لولاند بوسطن الدنماركية وشارلي إيبدو الفرنسية-

Abstract

حاولنا في هذا المقال أن نقدم صورةً لتداعيات أزمة الرسوم الكاريكاتيرية التي أثارتها الصحافة الغربية بعد نشرها للرسوم الدنماركية، من وجهة نظر حرية الرأي والتعبير التي يفصح بها الغرب بقصد الإساءة للعرب والمسلمين، وذلك من خلال مناقشة العلاقة بين حق الصحفي في الإعلام وحق الشخص في خصوصياته، والشعوب في رموزها، وكيف أن قوانينه وتشريعاته تناقض هذه الأطروحة، مشيرين إلى بعض هذه القوانين، كما بينا في هذه الورقة أهمية الكاريكاتير كفن صحفي يتمتع بحرية كبيرة تفوق باقي الفنون الصحفية وتحوله من وظيفة الفكاهة إلى وظيفة العدوان، ثم نظرة الديانات السماوية الكبرى لمسألة الرسم وكذا التعرض للآخرين بالقذف والإساءة في الديانات السماوية والقوانين الوضعية، ثم بينا في الختام الفرق بين الشخصية العامة والشخصية الخاصة، في كون الأولى يجوز نقدها باعتبارها ملكية عامة، وفي الأخير سيتم عرض مجموعة عامة من نتائج هذا البحث. ....................................................................................................................................................Nous essaierons à travers cet article de représenter la problématique soulevée publication de la presse occidentale du dessin caricatural danois.L’occident utilise son droit de la liberté d’expression pour nuire aux arabes et aux musulmans. Cependant, il existe une contradiction entre le droit du journaliste de publier l’information et le fait de mettre à nu la vie privée de l’individu et de bafouer les symboles fondateurs des peuples. Nous avons essayé de démontrer l’importance de la caricature considérée comme un art journalistique qui jouit d’une plus grande liberté que celle des autres modes artistiques. La caricature passe de la fonction humoristique à la haine. Le dessin est donc utilisé comme un moyen pour nuire au message divin.Pour finir, nous avons établi la différence entre l’être public et l’être anonyme.Le premier est critiquable car il appartient à la masse..................................................................................................................................................In this paper, we tried to present an image of the repercussions of the Cartoons Crisis caused by the Western Press after publishing the Danish Cartoons; from the point of view of the Freedom of Opinion and Speech drawled by the West aiming at offending the Arab and Muslim People; through the relation between the journalist right to information, the person's right to privacy and the peoples’ right to their symbols; explaining how its laws and legislations contradict this thesis by quoting some of these laws. We also showed, in this paper, the importance of the Caricature as journalistic art benefiting of considerable freedom that exceeds the rest of the journalistic arts, changing it from the humoristic function to that of aggression; then the point of view of the other great Monotheistic Religions on the issue of cartoons and giving offence to the others by mockery and defamation in the Monotheistic Religions and secular laws. Finally, we elucidate the difference between the Public and Private Figures; showing that the first one can be criticised considering it as a public property. At last, a general set of this research findings were exposed.
