تداولية الخطاب اللغوي عند علماء الأصول دراسة وظيفية في آليات فهم النصوص

Abstract

قد كان لدراسة المعاني و أساليب التّخاطب، عند الأصوليين، ضمن استعمالاتها وسياقاتها، مفتاح من مفاتيح الفهم، ورصد مقاصد المتكلمين، واستنباط الأحكام المتصلة بالمكلفين؛ فقادهم ذلك إلى تجريد القواعد ومعرفة مقصد الكلام، فاستنباط الأحكام التي تتصل بالمكلّفين توجب عليهم أن يطبقوا أفعالا وسلوكات وممارسات، جعلت الدراسات الأصولية تولى الأهمية للخطاب؛ فتوجهت توجها تداوليا وظيفيا، مكنتها من فهم النصوص الشرعية، آخذة بالوضع والاستعمال مبدأ أساسيا في الحمل والتفسير. ولما كانت هذه الأحكام متعلقة بأفعال كلامية وتواصلية؛ لا تتم إلا عبر اللغة، وجب على الأصوليين ربطها باستعمالاتها ووظائفها؛ قصد رصد المعنى، والنظر فيه ضمن نطاق تداوله، فقادهم ذلك إلى شرط تحققه، ومعرفة القصد منه، ذلك أنّ مقاصد المخاطبين لا يحكمها الوضع اللّغوي المجرّد بقدر ما يحكمها الاستعمال المتداول؛ فلا يمكن الوصول إليها إلاّ من خلال سياقها؛ هذا السياق الذي يتجدد بتجدد المتكلمين؛ باعتبار الكلام وبنياته بنى ثابتة، وسياقات ورودها سياقات متغيرة. ..................................................................................................................................................... The study of the meanings and methods of communication among the fundamentalists in their uses and contexts was a key to understanding and monitoring the purposes of the speakers and devising the provisions related to the taxpayers. This led to the abstraction of the rules and knowing the speech beyond meaning. In order to clarify the provisions relating to the taxpayers, Fundamentalist studies have given importance to the discourse; it has guided a functional deliberative approach, enabling it to understand the legal texts, taking into consideration the basic principle of sentences and interpretation. Since these provisions are related to verbal and communicative actions, which are carried out only through language, the fundamentalists realized that it should be link to their uses and functions; in order to monitor the meaning, and consider it within the scope of its contextual use. This leads to a condition to be achieved, and knowledge of the intention, as the purposes of the speakers are not governed by the language situation as abstract as governed by the common use, and It cannot be conveyed only through its context; this context is renewed by the renewal of speakers; as speech and its structures are fixed structures and contexts with variable contexts.
