آليات تفعيل الرقابة على دستورية القوانين في الجزائر في ظل التعديل الدستوري لسنة 2016

Abstract

تميزت الرقابة على دستورية القوانين في الجزائر في ظل التعديل الدستوري لسنة 1996 بالضعف، نظرا لجمود عمل المجلس الدستوري بسبب تضييق آلية الإخطار. لذلك اتجه المؤسس الدستوري بموجب التعديل الدستوري لسنة 2016، إلى وضع آليات جديدة تضمن تفعيل هذه الرقابة، والتي تتمثل في: ضمان استقلالية المجلس الدستوري كونه كهيئة وضمان استقلالية أعضائه، بفرض شروط تتعلق بالسن، والخبرة والتخصص في مجال القانون وتمتعهم بالحصانة القضائية، توسيع ممارسة حق الإخطار إلى الوزير الأول، نواب وأعضاء غرفتي البرلمان والأفراد من خلال الدفع بعدم الدستورية، والمعروفة في الفقه المقارن "بمسألة الأولوية الدستورية". يمكن أن نعتبر هذا التعديل نقلة نوعية وخطوة هامة نحو تدعيم مبدإ المشروعية وحماية الحقوق والحريات إذا تم تفعيله على المستوى العملي، خصوصا بعد صدور القانون العضوي رقم 18-16 المحدد لشروط وكيفيات تطبيق الدفع بعدم الدستورية....................................................................................................................................Le contrôle de la constitutionnalité des lois en Algérie s'est caractérisé, en vertu de la révision constitutionnelle de l’année 1996, par le laxisme, compte tenu du fonctionnement rigide du conseil constitutionnel résultant du rétrécissement du mécanisme de saisine. C'est la raison pour laquelle le législateur constitutionnel a développé, en vertu de la révision constitutionnelle de 2016, de nouveaux mécanismes pour assurer l’effectivité de ce contrôle : En garantissant l'indépendance du conseil constitutionnel en tant qu'organisme et en garantissant l'impartialité de ses membres en imposant des conditions d'âge, d'expérience et de spécialité dans le secteur juridique ainsi qu'en leur accordant l'immunité judiciaire. En élargissant l'exercice du droit de la saisine au premier ministre, aux députés et aux membres des deux chambres du Parlement ainsi qu’aux individus, en invoquant l’exception de l’inconstitutionnalité, connu dans la jurisprudence comparative par : « la question prioritaire de la constitutionnalité ». Nous pouvons considérer que cette révision constitue un saut qualitatif et un pas important en avant, vers le renforcement du principe de légalité et la protection des droits et libertés, si elle est activée aux niveaux pratique, surtout après la promulgation de la loi organique 18-16..............................................................................................................................................The control of the constitutionality of laws in Algeria was characterized by weakness after the 1996 constitutional amendment, given the stagnation in the action of the constitutional council, which resulted from the restriction of the mechanism of seisin. This is the reason why the constitutional founder decided under the constitutional amendment of 2016 to devise new mechanisms to ensure the activationof this control: - By guaranteeing the independence of the Constitutional Council as an organization and by guaranteeing the impartiality of its members by imposing conditions of age, experience and specialty in the legal sector as well as by granting them the judicial immunity. - By extending the exercise of the right of seisin to the Prime Minister, the Members of Parliament and the Members of both Chambers of Parliament and to individuals, on the exception of unconstitutionality, which is known in the comparative jurisprudence by: the question of constitutional priority. We can consider that this change represents a qualitative leap and a significant step towards the reinforcement of the principle of legality and the protection of rights and freedoms if it is activated at the practical level, especially after the promulgation of the organic law 18-16.
