دسترة الحقوق السياسية للمعارضة-أتجاه نحو تعزيز مبدأ الفصل بين السلطات-

Abstract

يعدّ مبدأ الفصل بين السلطات أحد أهم أسس الأنظمة الديمقراطية، وأهم المبادئ الدستورية، فهو يهدف إلى أنظمة سياسية تضمن الحقوق والحريات الفردية والجماعية، إلاَّ أن تطبيقه في الأنظمة المختلطة وفق صورته التقليدية، أصبح يثير إشكالات متعددة، خاصة مع بروز ظاهر للأغلبية البرلمانية، مما أدى إلى ظهور اتجاه جديد يهدف لتعزيز تجسيد المبدأ على أرض الواقع من خلال الفصل بين الأغلبية والمعارضة. هذا الاتجاه تبنته الجزائر من خلال الإصلاحات الدستورية التي أقرتها في التعديل الدستوري لسنة 2016 والتي بموجبها منحت للمعارضة حقوقا سياسية تمكنها من أن تلعب دوراً بارزا، وتساهم في تفعيل الدور الرقابي للبرلمان، لذلك سنتناول دوافع دسترة الحقوق السياسية للمعارضة، ووسائل تدخل المعارضة لتفعيل دور البرلمان تكريساً للاتجاه الجديد.//////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////Le principe de séparation des pouvoirs –le plus important en démocratie- est considéré comme la base des systèmes démocratiques, garants des droits et des libertés individuelles et collectives. Toutefois, son application -selon la version traditionnelle- dans les systèmes mixtes pose beaucoup de problèmes surtout avec l'apparition de la majorité parlementaire. Cet ordre des choses a engendré une nouvelle tendance visant la consolidation du principe dans ce nouveau contexte à travers la séparation entre la majorité et l'opposition. Cette a été adoptée par l'Algérie à travers les réformes constitutionnelles de l'année 2016 en donnant à l'opposition des droits politiques qui lui permettent de jouer un rôle de contrôle parlementaire. Pour ce faire, nous évoquerons les motivations constituantes des droits politiques de l'opposition, ainsi que les moyens de son intervention pour activer le rôle du parlement en concrétisant la nouvelle tendance//////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////The principle of powers' separation is one of the most important democratic systems and constitutional principles as it seeks to establish political systems that guarantee both individual and collective rights and freedoms. However, its implementation in mixed regimes according to the classical approach has caused many problems notably with the emergence of a parliamentary majority, which led to the appearance of a new trend aiming at promoting the realization of the principle in reality by separating the majority and the opposition. This trend is adopted by Algeria through the constitutional reforms set by the 2016 constitutional amendment under which the opposition was given political rights that enable it to play a prominent role and contribute in operationalizing the parliament control role. Therefore, this paper will shed light on the motives behind the constitutionality of the opposition’s political rights, and its intervention means to strengthen the new trend.
