Résumé:
تُعَد الرقابة والإشراف على الانتخابات من أهم الضمانات لتحقيق شفافية ونزاهة العمليات الانتخابية، لذلك أَولاهاَ المؤسس الدستوري من خلال التعديل الدستوري لسنة 2016 أهمية خاصة، حيث نص على عدة آليات دستورية منها إنشاء آلية جديدة تمثلت في الهيئة العليا المستقلة لمراقبة الانتخابات، التي أعطاها صلاحيات واسعة لضمان ممارسة دورها في مراقبة الانتخابات بشكل جدي وفعال، ثم تلتها السلطة الوطنية المستقلة للانتخابات التي دُسترت في التعديل الدستوري 2020، حيث تولت مسؤولية الإشراف والرقابة معاً، إضافة إلى العدد الهائل من القوانين والتنظيمات التي توالت خلال هذه الفترة.
تهدف الدراسة إلى الإلمام بكل أنواع الرقابة على العملية الانتخابية في ظل التعديل الدستوري 2016، بما في ذلك عمل الأجهزة المخصصة لذلك، ومدى توفيق المؤسس الدستوري والمشرع الجزائري في الوصول إلى نظام قانوني فعال وهذا ما عكفت عليه هذه الدراسة في الإحاطة بكل أشكال الرقابة والإشراف التي سُخرت لضمان انتخابات نزيهة وشفافة خلال كل مراحل العملية الانتخابية، مع تبيان مراكز القوة ومكامن الضعف في التشريعات المتتالية منذ التعديل الدستوري 2016، بهدف توسيع المشاركة السياسية التي تعبر عن مدى ديمقراطية أي الدّولة.

Oversight and supervision of elections is one of the most important guarantees for achieving transparency and integrity of electoral processes. Therefore, the constitutional founder, through the 2016 constitutional amendment, attached special importance to it stipulated several constitutional mechanisms, including the establishment of a new mechanism represented by the Independent High Commission for Election Monitoring, which gave it wide powers to ensure that its role in monitoring elections is exercised in a serious and effective manner.
Then came the Independent National Authority for Elections, which was constitutional zed in the constitutional amendment 2020, where it assumed the responsibility of supervision and oversight together, in addition to the huge number of laws and regulations that followed during this period.
This study focused on all forms of oversight and supervision that were harnessed to ensure fair and transparent elections during all stages of the electoral process with the clarification of the centers of strength and weaknesses in the successive legislation since the 2016 constitutional amendment, to expand political participation that expresses the extent of democracy in any country.
