واقع التحقيق العقاري للحصول على الدفتر العقاري الى غاية جانفي 2021 دراسة تحليلية لآخر مستجدات المسح العام في ولاية عنابة

Abstract

إن عملية التحقيق العقاري ذات أهمية قانونية وواقعية في تطهير الملكية العقارية، وتنظيم الأوعية العقارية، خاصة وأن المشرع استهدف من القانون ( 07-02) المتضمن إجراء لمعاينة الملكية وتسليم سندات الملكية عن طريق التحقيق العقاري أهدافا حساسة اعترضت عملية التطهير في الجزائر لاسيما معالجة ما خلفه العمل بمحررات سابقة كعقد الشهرة والسندات المحررة قبل 01 مارس 1961، وكذا تفعيل مساعي نظام الشهر العيني لاستكمال المسح العام للأراضي وتحقيق استثمارات أكبر للأموال العقارية وزيادة الدخل القومي للجزائر ، وكنموذج عملي اخترنا المحافظة العقارية لولاية عنابة للوقوف على آخر احصائيات المسح العقاري أي لغاية جانفي 2021، وما هي الإشكالات التي خلفتها الصيغ السابقة وكذا التحقيق العقاري كأحدثها. //////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////// The real estate investigation process is of important legal and realistic in the purification of real estate ownership and the regulation of real estate containers, especially since the legislator targeted the law (07-02) that includes a procedure for inspecting the property and the delivery of title deeds through real estate investigation sensitive goals that interfered with the purification process in Algeria Especially addressing what was left behind by working with previous documents such as the contract of goodwill and bonds issued before 01march1961, as well as activating the endeavors of the in-kind month system to complete the general survey of lands and achieve greater investments of real estate funds and increase the national income of Algeria, and as a practical model we chose the real estate governorate of the state of Annaba to find out the latest statistics of the real estate survey That is, until January 2021, and what are the problems left by the previous formulas, as well as the real estate investigation, such as the most recent. /////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////// Le processus d’enquête immobilière est d’une importance juridique et réaliste dans la purification de la propriété immobilière et la réglementation des conteneurs immobiliers, d’autant plus que le législateur a ciblé la loi (07-02) qui comprend une procédure d’inspection de la propriété et la livraison des titres de propriété par le biais d’une enquête immobilière, des objectifs sensibles qui ont interféré avec le processus de purification en Algérie avant le premier mars1961 système de mois aimable pour compléter le relevé général des terres, réaliser un plus grand investissement des fonds immobiliers et augmenter le revenu national de l’Algérie, et comme modèle pratique nous avons choisi le gouvernorat immobilier de l’état d’Annaba pour connaître les dernières statistiques de la enquête immobilière Soit, jusqu’en janvier 2021, et quels sont les problèmes laissés par les formules précédentes, ainsi que l’enquête immobilière, comme la plus récente.
