    الضمانات الموضوعية و الإجرائية لضحايا جريمة الاتجار بالبشر في إطار بروتوكول باليرمو لعام 2000

    أقر بروتوكول باليرمو لمنع وقمع و معاقبة الاتجار بالبشر لا سيما النساء و الأطفال ، جملة من الحقوق الأساسية لهاتين الفئتين، إذ أنه ناشد كل دولة عضو ضمان و حماية حقوق ضحايا هذه الجريمة و صيانة كرامتهم الإنسانية. و تتنوع هذه الحقوق بين حقوق موضوعية كالحق في السلامة و الحرمة الشخصية، الصحة، و حق العودة إلى الوطن، لأنها تؤكد على وجودهم القانوني كضحايا جريمة الاتجار بالبشر. و حقوق إجرائية تتعلق بحق الحصول على المعلومات و التمثيل القانوني، و الاستماع إلى أقوالهم أمام القضاء و جبر الأضرار. The Palermo protocol for preventing, suppressing and punishing Human trafficking crime, especially against Women and Children, has recognised a set of fundamental rights for these two categories. Thus, the protocol appealed each State member to guarantee and protect the rights of victims of this crime, and to safeguard their human dignity. These rights range from substantive rights such as the right to safety and personal inviolability, health, and the right to return home, as they emphasize their legal existence as victims of human trafficking. Procedural rights relate to the right to information and legal representation, to hear their statements before the courts and to redress damages.
