| dc.description.abstract | أمام غموض ومرونة موضوع الحق في البيئة، وأمام استبعاد القضاء للوجه المستخلص من خرق هذا الحق، فإن هذه الدراسة تستهدف تحديد مضمون الحق في البيئة، وتحديد أصحابه وطبيعته، وقد تم التوصل إلى أن موضوع هذا الحق له معنين: معنى ضيق يتمثل في البيئة الطبيعية، ومعنى واسع يشمل بالإضافة إلى ذلك الوسط الصناعي، وإلى أنه يجب تبني المعنى الضيق مضافا إليه الحيوانات والنباتات والتنوع الايكولوجي فحسب، بل يجب أكثر من ذلك السعي من أجل تجزئة هذا الحق إلى عدد من الحقوق المستقلة، كالحق في الماء والحق في الهواء...إلخ، وإلى أن الإنسان هو محور الحق في البيئة، وإلى أنه من الضروري أن يكون هذا الحق فرديا حتى نعطي فرصة أكبر لحمايته، على أن تتم ممارسته بصورة جماعية..........................................................................................................................................................Cette étude vise à définir le contenu du droit à l’environnement, et à en déterminer les détenteurs et la nature. Nous avons conclu que l’objet de ce droit a deux significations : un sens restreint englobant l’eau, l’air et le sol, et un sens large comprenant en plus des composants précédents l’environnement industriel. Nous devrions adopter le sens restreint en y ajoutant uniquement les animaux, les plantes et la diversité, non seulement cela, mais il faudrait également militer pour partager ce droit en un nombre de droits indépendants, tel que le droit à l’eau, le droit à l’air …, que l’Homme soit l’axe du droit à l’environnement, qu’il est nécessaire que ce droit soit individuel afin de donner plus de chance à sa protection, à condition qu’il soit exercé en commun. ..................................................................................................................................................................This study aims at defining the content of the right to environment, and determining the holdersof this right andits nature. Weconcluded that the object of this right has two significations: A restrictedsignification consisting of the natural environment, and alarge signification including besides the previous components the industrial environment. We also concluded that we should adopt the restricted signification, by adding animals, plants andenvironmental diversity. Furthermore, it would be necessary to try to divide this right in a number of independent rights, such as the right to water, the right to air…etc. This study also found that Manshould be the axis of the right to environment, and that this right should be individual in order to give it better protection, this right should be is exercised jointly. | en_US |
