| dc.description.abstract | تعالج هذه الأطروحة مختلف الجوانب القانونية المحيطة بموضوع الاختصاص القضائي الدولي للمحاكم الجزائرية وذلك من خلال محاولة تسليط الضوء على الدور الذي يلعبه "العنصر الأجنبي" في بلورة وتوجيه المنازعة الدولية الخاصة ووضعها أمام الجهات القضائية المختصة، ويتحقق ذلك من منطلق ضوابط الاختصاص القضائي الدولي المستمدة من القانون الجزائري والتي تعمل على حل مشكلة تنازع الاختصاص القضائي بين مختلف الجهات القضائية الدولية ذات العلاقة بالمنازعة المتضمنة عنصرا أجنبيا، أو إسناد المنازعة إلى المحاكم الجزائرية متى انعقد اختصاصها. .......................................................................................................................................................... This thesis treats the various legal aspects that surround the topic of international jurisdiction of the Algerian courts, through attempting to shed the light on the role of the “foreign element” in forging and directing the international private conflict, and putting it before the competent judicial authorities. This is achieved from the standpoint of the international jurisdiction controls that are derived from the Algerian law, which aim to resolve the dispute of jurisdiction between the international judicial bodies related to the dispute that includes a foreign element, or assigning the conflict to the Algerian courts when its jurisdiction occurs. | en_US |
