| dc.description.abstract | يعتبر التوقيع الالكتروني تقنية من التقنيات التي تسمح بتبسيط وتسهيل عملية التعاقد في العالم الافتراضي الذي يتميز بتبادل المعطيات والرسائل، ومع وجود هذه التقنية زاد الإقبال على التعاقد الالكتروني وبدأ خوف المتعاملين يتناقص تدريجيا في مواجهة التكنولوجيا الحديثة حيث تطورت معها تقنيات الامان والموثوقية، و يعمل التوقيع الالكتروني على توثيق البيانات والكتابة الالكترونية. وللتوقيع العادي أو الخطي دورين أساسين يتمثل الأول في التعريف بالشخص الموقع والثاني في ارتباط الموقع بمضمون الالتزام، بمعنى أن للتوقيع وظيفيتين من جهة يسمح بتحديد الشخص المتعاقد، ومن جهة أخرى يعبر المتعاقد عن إرادته ورضاه بمضمون العقد. وفي إطار التجارة الالكترونية يكون من الصعب جدا وضع التوقيع الخطي، لذا كان لابد من البحث عن توقيع يتلاءم ومقتضياتها وعليه يعتبر التوقيع الالكتروني في هذه الحالة ضروريا. The electronic signature is a mechanism that offers the choice of simplicity but not without security; it is now at the heart of contractual relationships; the fear of contracting parties of the virtuality of exchanges is gradually diminishing in the face of the development of security and reliability techniques. The ordinary or literary signature have two primary roles; the identification and commitment of its author. These two roles make it possible to mark the commitment of the parties, that is to say, two missions arise from identifying its author and therefore identifying the author on whom the signature appears, and marking the author's flywheel to adhere to the act express consent. In the context of electronic commerce, it is sometimes difficult or even impossible to mark a handwritten signature. This is why the electrification of the signature was necessary. | en_US |
