| dc.description.abstract | تعتبر ظاهرة الهجرة غير الشرعية من الظواهر المعاصرة، التي بذل المجتمع الدولي عديد الجهود لمواجهتها، وفي هذا المجال برزت عدة آليات ترمي إلى احتواء هذه الظاهرة، انطلاقا من سياسة التعامل مع المهاجرين غير الشرعيين، التي كانت تنطلق من حماية المهاجر غير الشرعي باعتباره ضحية، ثم تحولت إلى العفو عنه قصد الاستفادة منه بالدولة التي هاجر إليها، لتتحول بعد ذلك إلى عقابه وردعه، تحت مبرر الخطر الذي يمكن أن يشكله على أمن الدولة التي هاجر إليها، ومع تعدد هذه السياسات، لابد على الدولة أن تتبع السياسة التي تناسبها لاحتواء ظاهرة الهجرة غير الشرعية.
