dc.description.abstractيعتبر الحق في محاكمة عادلة من حقوق الإنسان الأساسية التي أشارت إليها المواثيق و الإعلانات الدولية المتعلقة بحقوق الإنسان، و بإعتبار أن القضاء الجنائي هو الجهة المنوط بها كفالة هذا الحق، قامت الأنظمة الأساسية للمحاكم الجنائية الدولية بتكريس مجموعة من القواعد التي ينبغي توافرها لضمان تحقيق العدالة و إحترام القانون، وتنطبق هذه القواعد على إجراءات القبض والاحتجاز، و على مرحلة التحقيق، كما تنطبق على جميع الإجراءات السابقة على المحاكمة، وأثناء المحاكمة، ولدى صدور الأحكام و استئنافها.
