| dc.description.abstract | يعالج موضوع التعويض عن الأضرار البيئية في التشريع الجزائري بيان مدى مساهمة المسؤولية المدنية التقصيرية في التعويض عن هذه الأضرار كنتيجة لغياب نصوص قانونية خاصة تعالج هذا الموضوع كما هو الحال بالنسبة للتشريعات الأوروبية. وبعد إبراز الصعوبات التي تواجه نظام المسؤولية الحالي الذي لا يتلاءم مع خصوصيات هذه الأضرار، كان من الضروري إصلاح هذا النظام وتدعيمه بآليات مكملة، والمتمثلة في نظام تأمين المسؤولية عن الأضرار البيئية، وكذا صناديق التعويضات البيئية كأحد أنظمة الضمان المالي، وهناك أيضا التعويض المكمل للضرر البيئي في إطار مبدأ الملوث الدافع عن طريق استحداث جباية بيئية تهدف إلى تحميل الملوث تكاليف إضراره بالبيئة..................................................................................................................................................Addresses the issue of compensation for environmental damage in the Algerian legislation indicate the extent of the contribution of civil liability in tort compensation for such damages as a result of the absence of special legal provisions to address this issue as is the case for European legislation. After highlighting the difficulties faced by the current liability system that does not fit with the specificities of these damages it was necessary to reform this system and strengthening the mechanisms of complementary and of liability insurance for environmental damage system, as well as environmental compensation fund as a financial security systems, and there is also a compensation supplementing the environmental damage under the principle of polluter driven by the introduction of an environmental levy that is designed to load contaminated costs harming the environment. | en_US |
