Abstract
كان الضبط هو المبرر العام والمشترك لإنشاء السلطات الإدارية المستقلة، فإن تمكين الحقوق في ظل التطورات التكنولوجية الهائلة يعد أيضا مبررا جوهريا لإنشائها.
ولذلك برزت سلطات الضبط الاقتصادي كإحدى أهم الأدوات الحديثة لضمان انسجام ضبط النشاطات الاقتصادية مع متطلبات حماية البيئة.
تنبع أهمية هذه الدراسة من حيث أنها تعالج تقاطعا حساسا بين مجالين حيويين، المجال الاقتصادي والذي يهدف إلى جلب الاستثمار في قطاعات حساسة كالطاقة، المحروقات، المناجم، الكهرباء والغاز، والمجال البيئي والذي يهدف إلى حماية التوازن الطبيعي وضمان حقوق الأجيال القادمة.
هذا التلاقي أثار تساؤل مهم للغاية يتعلق بمدى إسهام الأليات التي اعتمدتها النصوص المنشئة لسلطات الضبط الاقتصادي في حماية البيئة؟
توصلت الدراسة إلى أن سلطات الضبط الاقتصادي تعد من أهم الأليات المؤسساتية التي اعتمدها المشرع لتحقيق التوازن بين متطلبات التنمية الاقتصادية وحماية البيئة، إلا أنها لم تزود بضمانات وأليات كافية وهو ما أضعف من مساهمتها في حماية البيئة.

If regulation is the general and common justification for the creation of independent administrative authorities, then the empowerment of rights in light of tremendous technological developments is also a fundamental justification for their creation.
Economic regulatory authorities have therefore emerged as one of the most important modern tools for ensuring that economic activities are in harmony with environmental protection requirements.
The importance of this study stems from the fact that it addresses a sensitive intersection between two vital areas, the economic sphere, which aims to attract investment in sensitive sectors such as energy, fuels, mining, electricity, and gas and the environmental sphere, which aims to protect the natural balance and guarantee the rights of future generations.
This convergence raises a very important question regarding the extent to which the mechanisms adopted by the texts establishing economic regulatory authorities contribute to environmental protection.
The study concluded that economic regulatory authorities are among the most important institutional mechanisms adopted by the legislator to achieve a balance between the requirements of economic development and environmental protection, but they have not been provided with sufficient guarantees and mechanisms, which has weakened their contribution to environmental protection.

Si la réglementation est la justification générale et commune de la création d'autorités administratives indépendantes, l'autonomisation des droits dans le contexte des progrès technologiques considérables constitue également une justification fondamentale de leur création.
C'est pourquoi les autorités de régulation économique sont apparues comme l'un des principaux outils modernes permettant de garantir la conformité de la réglementation des activités économiques avec les exigences de protection de l'environnement.
L'importance de cette étude réside dans le fait qu'elle traite d'un croisement sensible entre deux domaines vitaux, le domaine économique qui vise à attirer les investissements dans des secteurs sensibles tels que l'énergie, les combustibles, les mines, l'électricité et le gaz, et le domaine environnemental qui vise à protéger l'équilibre naturel et à garantir les droits des générations futures.
Cette convergence a soulevé une question très importante concernant la mesure dans laquelle les mécanismes adoptés par les textes instituant les autorités de régulation économique contribuent à la protection de l'environnement.
L'étude a conclu que les autorités de régulation économique constituent l'un des principaux mécanismes institutionnels adoptés par le législateur pour concilier les exigences du développement économique et la protection de l'environnement, mais qu'elles ne sont pas dotées de garanties et de mécanismes suffisants, ce qui affaiblit leur contribution à la protection de l'environnement.
