    طرق تسوية منازعات عقد الوساطة المالية في سوق الأوراق المالية

    البورصة من أهم المؤسسات التي تقوم على توفير أموال للمستثمرين باستقطاب رؤوس الأموال من خلال جمع المدخرات المالية، ولذا تعد حماية المستثمر عند تنظيم سوق القيم المنقولة من أولويات المشرع، حيث يراعي عند وضع القوانين واللوائح والتنظيمات المتعلقة بهذا المجال تحقيق هذه الغاية، ولعل وضع نظام قضائي متكامل يسوي المنازعات بين كل أطراف هذه السوق يعد ركيزة أساسية للوصول إلى المبتغى، إلا أن الاتجاه الحديث آثر تبني الوسائل البديلة نظرا لتحقيقها السرعة المطلوبة لفض مثل هذه المنازعات والعدالة من خلال التخصص في هذا المجال وتجنب الخسائر الناتجة عن إطالة أمد النزاع، ومنه يمكننا أن نتساءل عن الطرق التي اعتمدها المشرع الجزائري لفض هذه المنازعات والإجراءات التي حددها مقارنة بالتشريعات السباقة في هذا المجال، وخلصنا إلى أن المشرع الجزائري وإن كان قد اعتمد على تسوية هذه المنازعات عن طريق لجنة تنظيم عمليات البورصة ومراقبتها من جهة إلا أنه لم يقصي دور القضاء في ذلك، وأغفل تحديد الاجراءات المتبعة أمامها، ولذا وقفنا على العديد من الجوانب والنقاط في التنظيم القانوني للمجال البورصي الحالي التي يجب على المشرع تعديلها وجعلها أكثر مرونة وانسجاما للارتقاء بالأمن القانوني في هذا المجال الحساس. ..................................................................................................................................................................... The exchange is one of the most important institutions that provide funds to investors by attracting capital through the collection of financial savings and therefore investor protection in regulating the market for transferred values is one of the legislators' priorities, In developing laws, regulations relating to this area, this objective shall be taken into account. The establishment of an integrated judicial system that resolves disputes between all parties to this market is a key pillar in reaching the desired end. However, the recent trend has affected the adoption of alternative means because of the speed required to resolve such disputes and justice by specializing in this area and avoiding losses resulting from prolonged conflict. and from which we can wonder what ways the Algerian legislature has adopted to resolve these disputes and what procedures it has set out in comparison with the preceding legislation in this area, We have concluded that, although Algerian legislators have relied on the settlement of these disputes through the Exchange's Operations Management and Control Commission on the one hand, however, it did not eliminate the role of the judiciary in that regard. But it did not define the procedures before it, and we therefore stood on many aspects and points in the legal regulation of the current Bursa area, which the legislator must amend and make more flexible and compatible to improve legal security in this sensitive area.
