    قواعد الاسناد كأسلوب فني لحل مشكلة تنازع القوانين

    تعتبر قواعد الإسناد واحدة من أهم القواعد الفنية التي تمكنت منذ أمد بعيد في حل معضلة تنازع القوانين، بل لازلت إلى يومنا هذا تشكل الوسيلة الأكثر شيوعا التي يلجأ إليها قضاء الكثير من الدول من أجل حل مشكلة تنازع القوانين في العلاقات ذات العنصر الأجنبي، وقد نظمها المشرع الجزائري في أحكام القانون المدني الجزائري، ونظم ضوابطها التي تحدد مجال إعمالها، ووسائل تفسيرها وتطبيقها على النحو الذي يسمح بتطبيق القانون الأكثر ارتباطا بعناصر العلاقة موضوع التنازع، غير أن التطورات الحاصلة في شتى مجالات الحياة خاصة الثورة التكنولوجية الحديثة، صاحبتها بعض الاشكالات في تطبيق قواعد الاسناد ونتج عنها ما يسمى أزمة قواعد الاسناد. .......................................................................................................................................................... Conflict rules are one of the most important technical rules that has long been able to resolve the conflict-of-laws dilemma and to this day it is still the most common means for the judiciary of many States to solve the problem of conflict of laws in foreign-race relations, regulated by the Algerian legislature in the provisions of the Algerian Civil Code and by the regulations governing its enforcement, The means of interpreting and applying them so as to permit the application of the law most closely linked to the elements of the relationship at issue But developments in various spheres of life, especially the modern technological revolution, was accompanied by some problems in the application of attribution rules and resulted in the so-called conflict rules crisis.
